Direction issued by the CommissionThe Commission by its proceedings dated 4.4.2018 had directed issuance of a notice u/s 18 of the PHR Act, 1993 to the Govt. of West Bengal to show cause as to why the Commission should not recommend payment of Rs.Five Lakhs as monetary compensation to the NoK of the deceased Uttam Mal who died as a result of custodial torture in the police custody of B-Zone Police Outpost under Durgapur P.S. Commissioner of Police, Asansole, Durgapur was also directed to inform the Commission about the outcome of FIR No.545/2012 P.S. Durgapur registered relating to the incident. In response, the Commissioner of Police, Asansole, Durgapur vide communication dated 1.6.2018 has submitted a report informing that the investigation of the case does not reveal any evidence to justify filing of charge sheet. A copy of the final report and the proceedings of Chief Judicial Magistrate Durgapur have also been enclosed. However, reply to the show cause notice has not been received by the Commission. Addl. Secretary, Home & Hill Affairs Department, Govt. of West Bengal vide communication dated 5.6.2018 has requested an additional time of two months’ to submit reply to the show cause notice. The time prayed for is granted. Let Addl. Secretary, Home & Hill Affairs Department, Govt. of West Bengal submit reply to the show cause notice within six weeks.
