राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया है कि तेलंगाना के नलगोंडा जिले में देवराकोंडा जिला परिषद हाई स्कूल फॉर गर्ल्स में शौचालय सुविधाओं की कमी के कारण छात्राओं को कठिनाइयों का सामना करना पड़ रहा है। कथित तौर पर, छात्राओं ने सुलभ परिसरों में मूत्रालयों का उपयोग करना शुरू कर दिया था, लेकिन वहां पर उनसे पैसे देने के लिए कहने पर उन्हें उनका उपयोग भी बंद करना पड़ा। इसके बाद, लड़कियों ने देवरकोंडा बस स्टॉप पर मुफ्त शौचालय का उपयोग करना शुरू कर दिया, हालांकि, प्रबंधन ने उन्हें शौचालय का उपयोग करने से रोक दिया तथा उन्हें वापस भेज दिया गया।
आयोग ने पाया है कि समाचार रिपोर्ट की सामग्री, यदि सही है, तो छात्राओं के मानव अधिकारों का गंभीर उल्लंघन है। स्कूलों में छात्रों, विशेषकर बालिकाओ हेतु शौचालय की सुविधा, प्रबंधन द्वारा सुनिश्चित और प्रदान की जाने वाली बुनियादी सुविधाओं में से एक है। छात्राओं को स्कूलों के बाहर सुलभ परिसरों और बस स्टॉप पर उपलब्ध सार्वजनिक शौचालयों का उपयोग करने के लिए मजबूर करना, छात्राओं की सुरक्षा के बारे में गंभीर लापरवाही के कई गंभीर मुद्दे उठाता है।
तदनुसार, आयोग ने तेलंगाना सरकार के मुख्य सचिव को नोटिस जारी कर चार सप्ताह में विस्तृत रिपोर्ट मांगी है। रिपोर्ट में ऐसी घटनाओं की पुनरावृत्ति न हो, उसे रोकने हेतु उठाए गए/उठाए जाने वाले प्रस्तावित कदम भी शामिल किए जाने चाहिए।

Issues notice to the Chief Secretary of the State seeking reports within four weeks
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report that the girl students are facing hardships due to the lack of toilet facilities in the Devarakonda Zila Parishad High School for Girls in Nalgonda district, Telangana. Reportedly, the girl students started using the urinals at Sulabh complexes but they had to discontinue using them when asked to pay money. After this, the girls started using free toilets at Devarakonda Bus Stop, however, the management stopped them from using the toilets and they were sent back.
The Commission has observed that the contents of the news report, if true, amount to a serious violation of the human rights of the girl students. The facility of toilets in the schools for the students, especially for the girl students, is one of the basic amenities to be ensured and provided by the management. Forcing the girl students to use the public toilets outside the schools at Sulabh complexes and the ones available at the bus stops, raises many issues of grave recklessness about the safety and security of the female students.
Accordingly, the Commission has issued notice to the Chief Secretary, Government of Telangana calling for a detailed report in four weeks. The report should include the steps taken/ proposed to be taken so that such incidents do not recur.

आयोग ने नागरिक समाज, गैर सरकारी संगठनों और मानव अधिकार के प्रतिनिधियों से भी बातचीत की
राष्ट्रीय मानव अधिकार आयोग (एनएचआरसी), भारत ने आज 30 लंबित मामलों की सुनवाई के बाद और आंध्र प्रदेश राज्य में मानव अधिकार उल्लंघन के पीड़ितों को राहत के रूप में लगभग 80 लाख रुपये की सिफारिश करने के बाद अपने एक दिवसीय विजयवाड़ा शिविर का समापन किया। एनएचआरसी के अध्यक्ष, न्यायमूर्ति श्री अरुण मिश्रा, सदस्य, डॉ. ज्ञानेश्वर एम मुले, श्री राजीव जैन और श्रीमती विजया भारती सयानी ने महासचिव, श्री भरत लाल, रजिस्ट्रार (विधि), सुरजीत डे, वरिष्ठ अधिकारियों, राज्य सरकार के संबंधित अधिकारियों एवं शिकायतकर्ताओं की उपस्थिति में मामलों की सुनवाई की।
आयोग ने अलग-अलग मामलों में उचित निर्देश पारित किए जैसे कि मेडिकल छात्रों के लिए छात्रावास में रहने और अत्यधिक फीस का भुगतान करने की कोई बाध्यता नहीं है, वह मामला जहां सरपंच को पुलिस ने अवैध रूप से हिरासत में रखा था, 25,000 रुपये का मुआवजा, पेंशन लाभ के विलंबित भुगतान पर ब्याज का भुगतान करने का आदेश तथा दिव्यांगजनों की तत्काल चिकित्सा जांच कर पेंशन में वृद्धि प्रदान करने आदि के लिए 80 लाख रुपये मुआवजे की सिफारिश की गई और मानव अधिकार उल्लंघन के पीड़ितों के लिए भुगतान प्रक्रिया शुरू की गई है।
आयोग ने 17 मामलों में अंतिम आदेश पारित किये, जिनमें से 05 मामलों को मुआवजे की संस्तुति के बाद बंद कर दिया गया है। आयोग ने राज्य पदाधिकारियों को यौन अपराधों के शिकार बच्चों के मुआवजे के मामलों में पॉक्सोि कोर्ट के समक्ष प्रस्ताव रखने का निर्देश दिया। अधिकारियों को यह सुनिश्चित करने के लिए निर्देश दिया गया कि 'पीड़ित मुआवजा योजना' के तहत मुआवजे का भुगतान एनएएलएसए द्वारा बनाए गए दिशानिर्देशों के अनुसार हो।
मामलों की सुनवाई के बाद, आयोग ने मानव अधिकारों के बारे में जागरूकता बढ़ाने के लिए मुख्य सचिव, पुलिस महानिदेशक और आंध्र प्रदेश सरकार के वरिष्ठ अधिकारियों के साथ बैठक की। आंध्र प्रदेश राज्य मानव अधिकार आयोग के अध्यक्ष और सदस्यों ने भी राज्य में नागरिकों के मानव अधिकारों के संरक्षण और संवर्धन हेतु अनुकूल वातावरण का निर्माण करने के उद्देश्य् से बैठक में भाग लिया।
आयोग ने अधिकारियों से मानसिक स्वास्थ्य, बंधुआ मजदूरी, भोजन और सुरक्षा का अधिकार, सीसैम, ट्रक ड्राइवर, नेत्र आघात, न्यायिक और पुलिस हिरासत में आत्महत्या की रोकथाम, हाथ से मैला ढोना आदि मुद्दों पर आयोग द्वारा जारी विभिन्न परामर्शियों पर की गई कार्रवाई की रिपोर्ट प्रस्तुत करने को कहा। उन्हें आयोग को समय पर रिपोर्ट प्रस्तुात करने के लिए भी कहा गया ताकि मानव अधिकार उल्लंघन के पीड़ितों को शीघ्र न्याय मिल सके। इस बात पर भी जोर दिया गया कि आयोग की सिफारिशों पर अनुपालन रिपोर्ट बिना किसी देरी के प्रस्तुत की जाए। मुख्य सचिव ने पूर्ण अनुपालन का आश्वासन दिया।
बाद में, आयोग ने नागरिक समाज, गैर सरकारी संगठनों और मानव अधिकार संरक्षकों के प्रतिनिधियों के साथ भी चर्चा की। उन्होंने मानव अधिकारों के उल्लंघन से संबंधित कई मुद्दों को उठाया, जैसे श्रवणबाधित और मानसिक रूप से दिव्यां ग व्यक्तियों के लिए शैक्षिक अवसरों की कमी, जिसके परिणामस्वरूप उन्हें पढ़ाई के लिए हैदराबाद जाना पड़ता है, मानसिक रूप से दिव्यांाग व्यक्तियों के लिए वाहनों की कमी, बाल गृहों में बच्चों के साथ दुर्व्यवहार, दुर्व्याएपार, ट्रांसजेंडर व्यक्तियों के लिए रोजगार के अवसरों की कमी, बांग्लादेशी महिला को वापस न भेजा जाना आदि।
आयोग ने राज्य में गैर सरकारी संगठनों और मानव अधिकार संरक्षकों द्वारा किए जा रहे कार्यों की सराहना की और उन्हें बिना किसी डर या पक्षपात के ऐसा करना जारी रखने के लिए प्रोत्साहित किया। यह चर्चा इस अवलोकन के साथ समाप्त हुई कि राष्ट्रीय मानव अधिकार आयोग के साथ गैर सरकारी संगठनों और मानव अधिकार संरक्षकों की निरंतर साझेदारी देश में मानव अधिकार शासन को मजबूत करने में काफी मदद करेगी। उन्हें यह भी बताया गया कि वे मानव अधिकार उल्लंघन की शिकायत hrcnet.nic.in के माध्यम से ऑनलाइन भी दर्ज कर सकते हैं
इसके बाद आयोग ने मीडिया को शिविर बैठक के निष्क र्ष के संबंध में जानकारी दी।

The National Human Rights Commission (NHRC), India today concluded its day-long Vijayawada camp sitting after hearing 30 pending cases and recommending about Rs.80 lakh as relief to the victims of human rights violations in the state of Andhra Pradesh. The NHRC Chairperson, Justice Shri Arun Mishra, Members, Dr. Dnyaneshwar M. Mulay, Shri Rajiv Jain and Smt. Vijaya Bharathi Sayani heard the cases in the presence of Secretary General, Shri Bharat Lal, Registrar (Law), Surajit Dey, senior officers, the concerned officers of the state government, and the complainants.
The Commission in different cases passed appropriate directions like no compulsion for the medical students to stay in the hostel and pay unaffordable exorbitant fees, compensation of Rs.25,000/- in a case where the Sarpanch was illegally kept in custody by the police, order for payment of interest on delayed payment of pensionary benefits, immediate medical examination of a disabled person to provide an increase in the pension, etc. Compensation of Rs. 80 lakh was recommended and the payment process has been initiated for the victims of human rights violations.
The Commission passed final orders in 17 matters, of which, 05 matters have been closed after recommending compensation. The Commission directed the state functionaries to put up the proposals before the POCSO Court in cases of compensation for child victims of sexual offences. The authorities were directed to ensure that payment of compensation under the ‘Victim Compensation Scheme’ is as per the guidelines framed by the NALSA.
After hearing the cases, the Commission held a meeting with the Chief Secretary, Director General of Police and senior officers of the Andhra Pradesh government for their sensitization about human rights. The Chairperson and Members of the Andhra Pradesh State Human Rights Commission also participated in the meeting to create an enabling environment to preserve protect & promote the human rights of citizens in the state.
The Commission asked the officers to submit action taken reports on various Advisories issued by the Commission on issues such as Mental Health, Bonded Labour, Right to Food & Safety, CSAM, Truck Drivers, Ocular Trauma, Prevention of Suicide in judicial and police custody, manual scavenging and others etc. They were asked to ensure timely submission of reports to the Commission so that victims of human rights violations get expeditious justice. It was also emphasized that compliance reports on the Commission’s recommendation are submitted without delay. The Chief Secretary assured full compliance.
Later, the Commission also interacted with the representatives of civil society, NGOs and human rights defenders. They raised a gamut of issues related to human rights violations like lack of educational opportunities for hearing impaired and mentally challenged persons as a result they have to go to Hyderabad for studies, lack of conveyance to mentally challenged persons, abuse of children in children’s homes, trafficking, lack of employment opportunities for transgender persons, non-repatriation of a Bangladeshi woman, etc.
The Commission appreciated the work being done by the NGOs and Human Rights Defenders in the State and encouraged them to continue doing so without fear or favour. The interaction concluded with the observation that the continued partnership of the NGOs & HRDs with the National Human Rights Commission will go a long way in strengthening the human rights regime in the country. They were also informed that they can file complaints of human rights violations online through hrcnet.nic.in
After this, the Commission briefed the media on the outcome of the camp sitting.

राष्ट्रीय मानव अधिकार आयोग (एनएचआरसी), भारत 6 मार्च, 2024 को कथित मानव अधिकार उल्लंघन के लंबित मामलों की सुनवाई के लिए विजयवाड़ा, आंध्र प्रदेश में एक दिवसीय शिविर बैठक आयोजित करने जा रहा है। एनएचआरसी अध्यक्ष, न्यायमूर्ति श्री अरुण मिश्रा, सदस्य, डॉ. ज्ञानेश्वर एम. मुले, श्री राजीव जैन और श्रीमती विजया भारती सयानी सुबह 10.30 बजे से पुलिस कमांड कंट्रोल सेंटर, आर एंड बी गेस्ट हाउस के पास, सिटी आर्म्ड रिजर्व मुख्यालय, लब्बीपेट, एमजी रोड पर मामलों की सुनवाई शुरू करेंगे।
इस दौरान एनएचआरसी के महासचिव, श्री भरत लाल, रजिस्ट्रार (विधि) श्री सुरजीत डे और अन्य वरिष्ठ अधिकारी भी उपस्थित रहेंगे। मामलों की सुनवाई के अलावा, शिविर बैठक का उद्देश्य न्यायसंगत और मैत्रीपूर्ण माहौल में उनके दरवाजे पर त्वरित न्याय प्रदान करके राज्य के अधिकारियों को मानव अधिकारों के प्रति संवेदनशील बनाना है। आयोग नागरिक समाज संगठनों, गैर सरकारी संगठनों के प्रतिनिधियों और मानव अधिकार संरक्षकों के साथ भी बातचीत करेगा ताकि उन्हें आयोग की आंख और कान के रूप में कार्य करने हेतु प्रोत्साहित किया जा सके।
राज्य के अधिकारियों और संबंधित शिकायतकर्ताओं को इन मामलों की सुनवाई के दौरान मौके पर ही विचार-विमर्श करने एवं निर्णय लेने हेतु उपस्थित रहने के लिए कहा गया है। कॉलेज अधिकारियों द्वारा अत्यधिक फीस वसूलना, पेंशन लाभ का भुगतान न करना, आदिवासियों को जबरन बेदखल करना, सफाई कर्मचारी की मौत, नाबालिग से बलात्कार आदि जैसे मामलों को खुली सुनवाई में उठाए जाने की संभावना है।
मामलों की सुनवाई के बाद, आयोग मानव अधिकारों के बारे में जागरूकता पैदा करने के संबंध में आंध्र प्रदेश के मुख्य सचिव, पुलिस महानिदेशक और अन्य वरिष्ठ अधिकारियों से मुलाकात करेगा। आंध्र प्रदेश के अध्यक्ष और सदस्य भी राज्य में नागरिकों के मानव अधिकारों को संरक्षित एवं संवर्धित करने हेतु अनुकूल वातावरण का निर्माण करने के लिए बैठक में भाग लेंगे।
आयोग उसी स्थान पर अपराह्न 2.00-3.15 बजे तक नागरिक समाज संगठनों, गैर सरकारी संगठनों के प्रतिनिधियों और मानव अधिकार संरक्षकों से मुलाकात करेगा। इसके बाद, अपराह्न 3.15 बजे से अपराह्न 3.45 बजे तक आयोग राज्य में मानव अधिकार मुद्दों पर जानकारी के व्यापक प्रसार और आयोग द्वारा की गई कार्रवाइयों के लिए शिविर बैठक के नतीजों के बारे में मीडिया को जानकारी देगा।
शिविर बैठक में इस तरह की सुनवाई मानव अधिकार उल्लंघन के पीड़ितों को त्वरित न्याय के लिए एक मंच प्रदान करती है। वर्ष 2007 से, आयोग ने उत्तर प्रदेश, बिहार, कर्नाटक, ओडिशा, गुजरात, असम, मेघालय, छत्तीसगढ़, मणिपुर, मध्य प्रदेश, पंजाब, केरल, पुडुचेरी, आंध्र प्रदेश, झारखंड, अंडमान और निकोबार, नागालैंड, उत्तराखंड, राजस्थान, अरुणाचल प्रदेश, पश्चिम बंगाल, तमिलनाडु और महाराष्ट्र सहित विभिन्न राज्यों में शिविर बैठकें भी आयोजित की हैं।

The National Human Rights Commission (NHRC), India is holding a one-day Camp Sitting at Vijayawada, Andhra Pradesh to hear the pending cases of alleged human rights violations on 6th March, 2024. The NHRC Chairperson, Justice Shri Arun Mishra, Members, Dr. Dnyaneshwar M. Mulay, Shri Rajiv Jain and Smt. Vijaya Bharathi Sayani will start the hearing of the cases from 10.30 A.M. at Police Command Control Centre, Beside R&B Guest House, City Armed Reserve Headquarters, Labbipet, MG Road.
NHRC Secretary General, Shri Bharat Lal, Registrar (Law) Shri Surajit Dey and other senior officers will also be present. Besides the hearing of cases, the Camp Sitting aims to sensitize the State officers about human rights by dispensing speedy justice at their door step in an equitous and friendly ambience. The Commission will also interacts with the representatives of civil society organizations, NGOs and human rights defenders to encourage them to act as eyes and ear of the Commission.
The State authorities and the complainants concerned have been asked to remain present at the hearing of these cases to facilitate on-the-spot deliberations and decisions. Cases such as charging exorbitant fees by college authorities, non-payment of pensionary benefits, forced eviction of tribals, death of sanitation worker, rape of a minor, etc., are likely to be taken up in the open hearing.
After the hearing of the cases, the Commission will meet the Chief Secretary, Director General of Police and other senior officers of Andhra Pradesh for their sensitization about human rights. The Chairperson and Members of the Andhra Pradesh will also participate in the meeting to create enabling environment to preserve protect & promote human rights of citizens in the state.
The Commission will be meeting the representatives of civil society organizations, NGOs and human rights defenders from 2.00-3.15 P.M. at the same venue. Thereafter, at 3.15 P.M.-3.45 P.M. the Commission will brief the media about the outcome of the Camp Sitting to have wider dissemination of information on human rights issues in the State and the actions taken by the Commission.
Such hearings in the Camp Sittings provide a platform for speedy justice to the victims of human rights violations. Starting from the year 2007, the Commission has also held camp sittings in various States including Uttar Pradesh, Bihar, Karnataka, Odisha, Gujarat, Assam, Meghalaya, Chhattisgarh, Manipur, Madhya Pradesh, Punjab, Kerala, Puducherry, Andhra Pradesh, Jharkhand, Andaman & Nicobar, Nagaland, Uttarakhand, Rajasthan, Arunachal Pradesh, West Bengal, Tamil Nadu and Maharashtra.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया है कि कर्नाटक के बेंगलुरु के राजाजीनगर स्टेशन पर एक अधिकारी ने एक किसान को मेट्रो ट्रेन में चढ़ने से इसलिए रोक दिया क्योंकि उसके कपड़े गंदे थे। कथित तौर पर, घटना का वीडियो सोशल मीडिया पर वायरल हो गया।
आयोग ने पाया है कि मीडिया रिपोर्ट की सामग्री, यदि सही है, तो यह उसके मानव अधिकारों का उल्लंघन है। किसी भी व्यक्ति को उसके पहनावे की प्रकृति के आधार पर लोक परिवहन तक पहुंच से वंचित नहीं किया जा सकता है। यदि किसी के पास कोई आपत्तिजनक सामग्री है तो उसे कानून के प्रावधानों के तहत ही रोका जा सकता है।
तदनुसार, आयोग ने कर्नाटक सरकार के मुख्य सचिव और बेंगलुरु मेट्रो रेल कॉर्पोरेशन लिमिटेड (बीएमआरसीएल) के प्रबंध निदेशक को नोटिस जारी कर चार सप्ताह के भीतर मामले में विस्तृत रिपोर्ट मांगी है। रिपोर्ट में यह सुनिश्चित करने के लिए उठाए गए/उठाए जाने वाले प्रस्तावित कदम भी शामिल होने चाहिए, ताकि ऐसी घटनाओं की पुनरावृत्ति न हो।
दिनांक 27 फरवरी 2024 को मीडिया में आई रिपोर्ट के अनुसार, वीडियो में किसान मेट्रो स्टेशन के बैग चेकिंग प्वाइंट पर सिर पर सामान की बोरी लेकर खड़ा दिख रहा था। जब एक अधिकारी ने किसान को रोका, तो एक अन्य यात्री ने अधिकारी की हरकत पर आपत्ति जताई और उससे वह नियम दिखाने को कहा जिसके तहत मेट्रो यात्रियों के लिए ड्रेस कोड अनिवार्य है या क्या मेट्रो केवल वीआईपी लोगों के लिए ही है। उन्होंने घटना का वीडियो सोशल मीडिया पर शेयर किया।

The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report that a farmer was stopped from boarding a metro train by an official at the Rajajinagar station, Bengaluru in Karnataka because his clothes were untidy. Reportedly, the video of the incident went viral on social media.
The Commission has observed that the contents of the media report, if true, amount to a violation of human rights. No person can be denied access to public transport based on the nature of the clothes he or she is wearing. If someone possesses any objectionable material, he could be stopped only as per the provisions of the law.
Accordingly, it has issued notices to the Chief Secretary, Government of Karnataka and the Managing Director, Bengaluru Metro Rail Corporation Limited (BMRCL), calling for a detailed report within four weeks. It should also include the steps taken/ proposed to be taken to ensure that such incidents do not recur.
According to the media report, carried on 27th February, 2024, the farmer was visible in the video standing with a sack of goods on his head at the bag checking point of the metro station. When an official stopped the farmer, another passenger objected to his action and asked him to show the rule that made a dress code mandatory for the metro passengers or whether the metro was meant only for VIPs. He shared the video of the incident on social media.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक ऑनलाइन शिकायत को प्रथम दृष्टया में ही खारिज कर दिया है जिसमें आरोप लगाया गया है कि सिविल अपील संख्या 2874/2024 कुलदीप कुमार बनाम यू.टी. चंडीगढ़ एवं अन्य के संबंध में, उच्चतम न्यायालय के दिनांक 20 फरवरी, 2024 के निर्णय के परिणामस्वरूप चंडीगढ़ मेयर चुनाव के पीठासीन अधिकारी, श्री अनिल मसीह के मानव अधिकारों का उल्लंघन हुआ है।
शिकायत सुप्रीम कोर्ट/हाई कोर्ट्स लिटिगेशन सोसाइटी (एससीएचसीएलए) की ओर से दायर की गई थी। यह आरोप लगाया गया था कि शीर्ष अदालत के आदेश से भारत के संविधान के अनुच्छेद 20 और 21 के तहत प्रदत्त मौलिक/संवैधानिक अधिकारों का उल्लंघन हुआ है।
शिकायत की सामग्री तथा उच्चतम न्यायालय के उक्त निर्णय को पढ़ने के बाद, आयोग ने पाया है कि श्री मसीह को अदालत द्वारा जारी अपने नोटिस पर जवाब दाखिल करने और सीआरपीसी की धारा 340 के तहत उनके खिलाफ शुरू की जाने वाली कार्यवाही का विरोध करने का अवसर दिया है। इसलिए, यदि शिकायतकर्ता चाहे तो अपनी शिकायतों को उचित मंच पर व्यक्त करने के लिए उपलब्ध वैकल्पिक उपायों का प्रयोग करें। इस प्रकार, यह स्वीकार किया गया है कि मामला आगे की सुनवाई हेतु उच्चतम न्यायालय के समक्ष लंबित है और इस प्रकार, यह विचाराधीन है। इसलिए, एनएचआरसी (प्रक्रिया) विनियम, 1994 के विनियम 9 (XI) के मद्देनजर, याचिका सुनवाई योग्य नहीं है।
आयोग की यह भी राय है कि अन्यथा भी यह प्रचलित कानून है कि न्यायिक कार्यवाही में त्रुटियों, यदि कोई हो, के सुधार के लिए, पीड़ित पक्ष या पीड़ित पक्ष का प्रतिनिधित्व करने वाले किसी भी व्यक्ति को उस अदालत के समक्ष, जहां मामला आगे विचार के लिए लंबित है, अपील, पुनरीक्षण, समीक्षा, उपचारात्मक याचिका के रूप में सुधारात्मक मशीनरी की सुस्थापित व्यवस्था का लाभ उठाना चाहिए। इसलिए, मामले में शिकायत पर एनएचआरसी द्वारा विचार नहीं किया जा सकता है।

NHRC dismisses in limini a complaint alleging SC’s judgment in gross violation of constitutional rights of Shri Anil Masih, Presiding Officer, Chandigarh Mayor Election
Describes the matter as sub-judice in the Apex Court and hence not maintainable under PHR Act
Says the aggrieved party or anybody representing it has to approach the concerned court for correcting an order in a judicial proceeding as per the trite law
The National Human Rights Commission, NHRC, India has dismissed in limini an online complaint alleging that the Supreme Court’s 20th February, 2024 judgment in the Civil Appeal No. 2874 of 2024 concerning Kuldeep Kumar vs. U.T. of Chandigarh and Others, has resulted in the violation of human rights of Shri Anil Masih, Presiding Officer, Chandigarh Mayor Election.
The complaint was filed on behalf of the Supreme Court/High Courts Litigation Society (SCHCLA). It was alleged that the order of the Apex Court violated the fundamental/constitutional rights under Articles 20 and 21 of the Constitution of India.
After going through the contents of the complaint and the Supreme Court judgment under reference, the Commission has observed that Shri Masih has been given an opportunity by the court to file his response to its notice and contest the initiation of proceedings against him under Section 340 of Cr.P.C. Therefore, there is alternate remedy available to the complainant to approach the appropriate forum to ventilate the grievances, if so desires. As such admittedly, the matter is pending before the Supreme Court for further consideration and thus, it is sub-judice. Therefore, in view of the Regulation 9 (XI) of the NHRC (Procedure) Regulations, 1994, the petition is not maintainable.
The Commission is of further opinion that even otherwise it is trite law that for correction of errors, if any, in a judicial proceeding, the aggrieved party or anybody representing the aggrieved party, has to avail the well-established gamut of corrective machinery in the form of appeal, revision, review, curative petition before the court where the matter is pending for further consideration. Therefore, the complaint in the matter cannot be entertained by the NHRC.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने मीडिया रिपोर्टों पर स्वत: संज्ञान लिया है कि 24 फरवरी, 2024 को नई दिल्ली के तुगलक लेन इलाके में आवारा कुत्तों के एक झुंड ने दो साल की एक बच्ची को कथित तौर पर नोंचकर जख्मी कर दिया, जिसके परिणामस्वरूप उसकी मृत्यु को गई। इलाके के निवासियों ने कथित तौर पर बताया है कि कुछ महीने पहले भी परिवार का एक और बच्चा इसी तरह के हमने का शिकार हुआ था। उन्होंने आवारा कुत्तों की बढ़ती संख्या और बच्चों पर हमले की घटनाओं को लेकर कई बार अधिकारियों से शिकायत की लेकिन कोई कार्रवाई नहीं हुई।
आयोग ने पाया है कि मीडिया रिपोर्ट की सामग्री, यदि सच है, तो यह मानव अधिकार उल्लंघन का गंभीर मामला है। दिल्ली में आवारा कुत्तों के हमलों के कारण मानव जीवन की क्षति का यह इकलौता मामला नहीं है। पहले की दुखद घटनाओं का संज्ञान लेते हुए, आयोग ने शहर के नगर अधिकारियों को केंद्र द्वारा जारी पशु जन्म नियंत्रण (कुत्ते) नियम, 2001 के प्रावधानों के अनुसार आवारा कुत्तों की आबादी को नियंत्रित करने के लिए सभी निवारक और उपचारात्मक कार्रवाई करने का निर्देश दिया था। यह नवीनतम घटना प्रचलित सुरक्षा उपायों की समीक्षा करने की आवश्यकता को इंगित करती है।
तदनुसार, आयोग ने मुख्य सचिव, राष्ट्रीय राजधानी क्षेत्र, दिल्ली सरकार, आयुक्त, नई दिल्ली नगर निगम और पुलिस आयुक्त, दिल्ली को नोटिस जारी कर छह सप्ताह के भीतर विस्तृत रिपोर्ट मांगी है। राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार से यह सूचित करने की अपेक्षा की जाती है कि क्या मृतक के निकटतम संबंधी (एनओके) को कोई राहत दी गई है। दिल्ली के पुलिस आयुक्त को मामले में एफआईआर दर्ज होने के बाद की जा रही जांच की वर्तमान स्थिति प्रस्तुत करने का निर्देश दिया गया है।
साथ ही, आयोग ने कहा है कि पशुओं के अधिकारों की भी मानव अधिकारों की तरह ही वकालत और समर्थन किया जाता है। हाल के दिनों में देश के कई हिस्सों से इसी तरह की घटनाएं सामने आई हैं और इस तरह यह किसी एक राज्य या केंद्र शासित प्रदेश के लिए समस्या नहीं है। स्थिति गंभीर और चिंताजनक है, जिसके लिए अधिकारियों द्वारा बिना किसी देरी के तत्काल और प्रभावी कार्रवाई की आवश्यकता है। सर्वोच्च न्यायालय ने अपने विभिन्न फैसलों में यह भी उल्लेख किया है कि यह स्पष्ट है कि किसी व्यक्ति के जीवन और स्वास्थ्य के अधिकार अपरिहार्य हैं। इसलिए, जीवन के मानव अधिकारों का संरक्षण करने की आवश्यकता है।
26 फरवरी, 2024 की मीडिया रिपोर्टों के अनुसार, इलाके में एक समारोह चल रहा था, जिसके कारण शनिवार शाम 6:00 बजे के आसपास डीजे पर बजने वाले तेज संगीत के कारण हमले के दौरान के लड़की की चीखें सुनाई नहीं दीं। निवासियों ने कथित तौर पर कहा कि इस मुद्दे के समाधान के लिए उन्होंने इलाके में आवारा कुत्तों को खाना खिलाने वाली महिला से संपर्क किया, लेकिन मामले में सहयोग करने के बजाय, उन्हें धमकी दी गई। कथित तौर पर, नई दिल्ली नगर निगम (एनडीएमसी) की एक टीम ने भी पुष्टि की है कि क्षेत्र में कुछ अस्थायी कॉटेज और डॉग शेल्टर आवारा कुत्तों को खाना खिलाते पाए गए।

The National Human Rights Commission, NHRC, India has taken suo motu cognizance of media reports that a two-year-old girl was allegedly mauled to death by a pack of stray dogs in the Tughlak Lane area of New Delhi on 24th February, 2024. The residents of the area have reportedly said that another child of the family had fallen victim to a similar attack a few months ago. They made several complaints to the authorities about the increasing number of stray dogs and incidents of attack on children but no action was taken.
The Commission has observed the contents of the media report, if true, amount to a grave issue of human rights violation. This is not an isolated case of loss of human life due to attacks by stray dogs in Delhi. Taking cognizance of the earlier tragic incidents, it had directed the city civic authorities to take all preventive and curative action to control the population of stray dogs as per provisions of the Animal Birth Control (Dogs) Rules, 2001, issued by the Centre. This latest incident indicates a need to review the prevailing safeguards.
Accordingly, the Commission has issued notices to the Chief Secretary, Government of NCT of Delhi, the Commissioner, New Delhi Municipal Corporation and the Commissioner of Police, Delhi, calling for a detailed report within six weeks. The Government of NCT of Delhi is expected to inform whether any relief has been given to the deceased's Next of Kin (NoK). The Commissioner of Police, Delhi, is directed to submit the present status of the investigation being conducted after registration of the FIR in the matter.
The Commission has further observed that animal rights are advocated and supported in the same way as human rights. Similar incidents have been reported from many parts of the country in the recent past and as such this is not a problem for any one state or Union Territory. The situation is grim and alarming, requiring immediate and effective action by the authorities without any delay. The Apex Court has also mentioned in its various pronouncements that there is no ambiguity that a person's rights to life and health are inalienable. Therefore, there is a need to protect human rights to life.
According to the media reports carried on 26th February, 2024, a function was going on in the locality, due to which the loud music from nearby DJ sessions drowned out the girl's screams during the attack around 6:00 pm on Saturday. The residents reportedly said that to address the issue they approached the woman known to be feeding stray dogs in the area but instead of cooperating in the matter, they were threatened. Reportedly, a team of the New Delhi Municipal Corporation (NDMC) has also confirmed that some temporary cottages and dog shelters are found to be feeding stray dogs in the area.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया है कि दिनांक 19 फरवरी, 2024 को अजमेर केंद्रीय कारागार में एक 45 वर्षीय एचआईवी पॉजिटिव कैदी की संदिग्ध परिस्थितियों में मौत हो गई। कथित तौर पर, जेल कर्मचारियों के साथ लड़ाई के दौरान लोहे की छड़ (रॉड) से खुद को मारने के बाद कैदी की मौत हो गई।
आयोग ने पाया है कि मीडिया रिपोर्ट की सामग्री, यदि सही है, तो यह मानव अधिकारों के उल्लंघन का मामला है, जो जेल अधिकारियों की ओर से बरती गई लापरवाही की ओर इशारा करती है। जेल अधिकारियों को लोहे की छड़ जैसी वस्तुओं को कैदियों की पहुंच से दूर रखने के लिए अतिरिक्त सावधानी और सुरक्षा बरतनी चाहिए थी। तदनुसार, आयोग ने महानिदेशक, कारागार, राजस्थान को नोटिस जारी कर छह सप्ताह के भीतर मामले में विस्तृत रिपोर्ट मांगी है।
रिपोर्ट में जेल में प्रवेश के बाद से मृतक का पूरा मेडिकल रिकॉर्ड, जांच रिपोर्ट, पोस्टमार्टम रिपोर्ट, उसकी वीडियो रिकॉर्डिंग और मजिस्ट्रियल जांच रिपोर्ट के अलावा, ऐसी घटनाओं की पुनरावृत्ति न हो, यह सुनिश्चित करने के लिए उठाए गए/उठाए जाने वाले प्रस्तावित कदम भी अपेक्षित है।
आयोग ने अधिकारियों से मृतक कैदी की सही उम्र के बारे में भी जानकारी मांगी है क्योंकि अधीक्षक, अजमेर केंद्रीय कारागार की सूचना में मृत कैदी की उम्र 61 वर्ष बताई गई है।

The report sought within six weeks
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report that a 45-year-old HIV-positive prisoner died inside the Ajmer Central Jail under suspicious circumstances on 19th February, 2024. Reportedly, the prisoner died after hitting himself with an iron rod during a fight with the prison staff.
The Commission has observed that the contents of the media report, if true, indicate negligence on the part of jail authorities raising an issue of human rights violations. The jail authorities should have taken extra care and protection to keep such items as iron rods out of the reach of prisoners. Accordingly, it has issued notice to the Director General of Prisons, Rajasthan calling for a detailed report in the matter within six weeks.
The report is expected to include his complete medical record right since entry to the prison, inquest report, post-mortem report, video recording of the same and magisterial enquiry report besides the steps taken/ proposed to be taken to ensure that such incidents do not recur.
The Commission has also asked the authorities to inform about the correct age of the deceased prisoner as in the intimation from the Superintendent, Ajmer Central Jail the age of the deceased prisoner is mentioned 61 years.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने प्रिंट और इलेक्ट्रॉनिक मीडिया रिपोर्टों पर स्वत: संज्ञान लिया है कि दिनांक 15 फरवरी, 2024 को दिल्ली के अलीपुर में एक पेंट कारखाने में लगी भीषण आग के कारण सात श्रमिकों की जलकर मौत हो गई। कथित तौर पर, अधिक श्रमिकों की मौत भी हो सकती थी, जैसा कि आग से बचने के लिए कारखाने से बाहर निकलने हेतु केवल एक ही गेट था तथा कोई आपातकालीन निकास नहीं था। पीड़ितों की अभी तक पहचान नहीं हो पाई है।
आयोग ने पाया है कि समाचार रिपोर्ट की सामग्री, यदि सही है, तो यह पीडि़तों के मानव अधिकारों के उल्लंघन का गंभीर मुद्दा उठाती है। तदनुसार, आयोग ने दिल्ली के मुख्य सचिव और पुलिस आयुक्त को नोटिस जारी कर छह सप्ताह के भीतर मामले में विस्तृत रिपोर्ट मांगी है। रिपोर्ट में एफआईआर की स्थिति और पीड़ित परिवारों को दिए गए मुआवजे का विवरण शामिल होना चाहिए। आयोग इस त्रासदी के लिए जिम्मेदार दोषी अधिकारियों के खिलाफ की गई कार्रवाई के बारे में भी जानना चाहेगा।
नोटिस जारी करते हुए, आयोग ने आगे पाया है कि यह आग लगने की कोई अकेली घटना नहीं है, जहां हाल के दिनों में राष्ट्रीय राजधानी में नियोक्ताओं और अधिकारियों की लापरवाही के कारण निर्दोष श्रमिकों की मौतें हुई हैं। ऐसा प्रतीत होता है कि लोक सेवकों ने पिछली त्रासदियों से कोई सबक नहीं लिया है।
इसलिए, आयोग ने राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार को राष्ट्रीय राजधानी में फैक्टरी अधिनियम के अनुसार सुरक्षा दिशानिर्देशों का पालन किए बिना अवैध रूप से चल रही खतरनाक रसायनों और अन्य ज्वलनशील पदार्थों का निर्माण करने वाली सभी औद्योगिक इकाइयों का सर्वेक्षण करने और छह सप्ताह के भीतर एक रिपोर्ट प्रस्तुत करने का का निर्देश दिया है। रिपोर्ट में निर्दोष लोगों के जीवन के अधिकार का उल्लंघन करने वाली ऐसी घटनाओं की पुनरावृति न हों, यह सुनिश्चित करने हेतु उठाए गए/उठाए जाने वाले प्रस्तावित कदमों को भी शामिल किया जाना चाहिए।
मीडिया रिपोर्ट्स के मुताबिक, मई, 2022 में मुंडका मेट्रो स्टेशन के पास एक चार मंजिला व्यावसायिक इमारत में भीषण आग लगने से बीस लोगों की जान चली गई थी। जनवरी 2018 में, दिल्ली में उत्तर पश्चिमी दिल्ली के बवाना औद्योगिक क्षेत्र में एक अवैध पटाखा पैकेजिंग इकाई में आग लगने से सत्रह श्रमिकों की मौत हो गई।

The National Human Rights Commission, NHRC, India has taken suo motu cognizance of print and electronic media reports that seven workers were charred to death in a massive fire that broke out inside a paint factory in Alipur, Delhi on 15th February, 2024. Reportedly, more workers may have died as no one was able to escape because the factory had only one gate and there was no emergency exit. The victims are yet to be identified.
The Commission has observed that the contents of the news report, if true, raise a serious issue of violation of human rights. Accordingly, it has issued notices to the Chief Secretary and the Commissioner of Police, Delhi calling for a detailed report in the matter within six weeks. It should include the status of the FIR and the disbursement of compensation to the aggrieved families. The Commission would also like to know about the action taken against the delinquent officers, responsible for the tragedy.
Issuing the notices, the Commission has further observed that this is not an isolated incident of fire where innocent workers have died due to negligence by the employers and the authorities in the National capital in the recent past. The public servants appear to have not taken any lessons from the previous tragedies.
Therefore, the Commission has directed the Government of NCT of Delhi to conduct a survey of all industrial units manufacturing hazardous chemicals and other inflammable substances, running illegally without following the safety guidelines as per the Factories Act in the national capital and submit a report within six weeks. The report should also include the steps taken/ proposed to be taken to ensure that such incidents violating the right to life of innocent people do not recur.
According to the media reports, in May, 2022 twenty people lost life in a massive fire at a four-storey commercial building near Mundka Metro station. In January 2018, seventeen workers died in a fire at an illegal firecracker packaging unit in Northwest Delhi’s Bawana Industrial area in Delhi.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने प्रिंट और इलेक्ट्रॉनिक मीडिया रिपोर्टों पर स्वत: संज्ञान लिया है, रिपोर्टों के अनुसार पश्चिम बंगाल के उत्तर 24 परगना के संदेशखाली में एक राजनीतिक व्यक्ति के स्थानीय गिरोह द्वारा निर्दोष और गरीब महिलाओं को परेशान किया गया और उनका यौन उत्पीड़न किया गया। जिसके परिणामस्वरूप, पिछले कुछ दिनों से, स्थानीय ग्रामीणों ने विभिन्न गुंडों और असामाजिक तत्वों द्वारा किए गए भयावाह अपराधों के अपराधियों के खिलाफ उचित कानूनी कार्रवाई के लिए विरोध प्रदर्शन शुरू कर दिया , जब स्थानीय प्रशासन अपराधियों के खिलाफ उचित कानूनी कार्रवाई करने में विफल रहा।
यह भी बताया गया है कि महिलाओं के साथ-साथ बच्चों और वृद्धजनों की सुरक्षा खतरे में पड़ गई है। इसका परिणाम यह हुआ है कि महिलाओं को उन पर होने वाले अत्याचार और यौन शोषण के कारण अपना निवास स्थान छोड़ना पड़ा है।
आयोग ने पाया है कि संदेशखाली में हाल की घटनाएं, जैसा कि विभिन्न प्रिंट और इलेक्ट्रॉनिक मीडिया में रिपोर्ट किया गया है, प्रथम दृष्टया अंतरात्मा को झकझोर देने वाले मानव अधिकारों के उल्लंघन का संकेत देती है। इसलिए, मानव अधिकारों को संरक्षित, सुरक्षित और संवर्धित करने हेतु पीएचआर अधिनियम, 1993 की धारा 12 (ए) के तहत अपने अधिकार क्षेत्र का प्रयोग करना और हिंसा की रिपोर्ट की गई घटनाओं का स्वत: संज्ञान लेना अनिवार्य हो जाता है।
तदनुसार, आयोग ने पश्चिम बंगाल सरकार के मुख्य सचिव और पुलिस महानिदेशक को नोटिस जारी कर उत्तर 24 परगना के संदेशखाली और अन्य इलाकों में हुई हिंसा, अपराध करने वालों के विरुद्ध की गई या की जाने वाली कार्रवाई, सुरक्षा और प्रस्तावित कार्रवाई,महिलाओं सहित स्थानीय लोगों के बीच विश्वास जगाने के लिए उठाए गए या उठाए जाने वाले अन्य सुधारात्मक उपाय, हिंसा के पीड़ितों को मुआवजा, यदि कोई हो, भुगतान किया जाना चाहिए या किया जाना चाहिए के संबंध में चार सप्ताह के भीतर रिपोर्ट मांगी है।
मामले की गंभीरता को देखते हुए, आयोग ने उत्तर 24 परगना के संदेशखाली में मानवाधिकारों की हिंसा की घटनाओं की मौके पर जांच करके तथ्यों का पता लगाने के लिए अपनी टीम को तैनात करना उचित समझा है। टीम का नेतृत्व आयोग के एक सदस्य द्वारा किया जाएगा जिसकी सहायता आयोग के अधिकारी करेंगे।
नोटिस जारी करते हुए आयोग ने आगे कहा है कि जीवन अपने आप में अनमोल है, जिसमें गरिमा, स्वतंत्रता, समानता और स्वतंत्रता के अधिकार शामिल हैं। संवैधानिक रूप से प्रदत्त इन अधिकारों की रक्षा करना राज्य का परम कर्तव्य है।

Expressing serious concern, issues notices to the State Chief Secretary and DGP calling for reports within four weeks

The National Human Rights Commission, NHRC, India has taken suo motu cognizance of print and electronic media reports that in Sandeshkhali, North 24th Paragana, West Bengal, innocent and impoverished women have been harassed and sexually assaulted by a group of local gang of a political person, as a result of which, for last few days, local villagers have started protesting for appropriate legal action against the perpetrators of horrific crimes indulged by various goons and anti-social elements, when the local Administration failed to take appropriate legal action against the perpetrators of crime.
It has also been reported that safety and security of the women folk as well as children and aged persons have been jeopardized. It has resulted in leaving the places of abode by the women due to torture and sexual abuse that are looming large upon them.
The Commission has observed that the recent incidents in Sandeshkhali, as have been reported in various print and electronic media indicate prima facie violation of human rights shocking the conscience. Therefore, it becomes imperative for it to exercise its jurisdiction under Section 12 (a) of the PHR Act, 1993 to preserve, protect and promote human rights, and take suo motu cognizance of the reported incidents of violence.
Accordingly, it has issued notices to the Chief Secretary and Director General of Police, Government of West Bengal seeking reports within four weeks with regard to violence that took place, as reported, in Sandeshkhali, North 24 Parganas and the action taken or proposed to be taken against the perpetrators of crime, safety and other ameliorative measures taken or proposed to be taken to inspire confidence amongst the local people, including women, compensation, if any, paid or to be paid to the victims of violence.
Considering the gravity of the matter, the Commission has also considered it deem fit and proper to depute its team to ascertain facts by a spot-enquiry into the incidents of violence of human rights in Sandeshkhali, North 24 Parganas. The team shall be led by a Member of the Commission who shall be assisted by officers of the Commission.
Issuing the notices, the Commission has further observed that life is precious in itself, which encompasses the rights to dignity, freedom, equality and liberty. It is the solemn duty of the State to protect these rights as constitutionally guaranteed.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक शिकायत पर स्वत: संज्ञान लिया है कि रिपब्लिक बांग्ला टीवी के पत्रकार श्री संतू पान को 19 फरवरी, 2024 को संदेशखली, पश्चिम बंगाल में महिलाओं के खिलाफ अपराधों को कवर करते समय गैरकानूनी रूप से हिरासत में लिया गया था। कथित तौर पर, बिना किसी पूर्व सूचना के, पुलिस कर्मियों ने पीड़ित को घेर लिया, उसके साथ मारपीट की और उसे जबरन अवैध हिरासत में ले लिया। शिकायतकर्ता, जो पत्रकार की पत्नी है, ने यह भी आरोप लगाया है कि उसको अपने पति से मिलने नहीं दे रहे है और वह उसकी सुरक्षा के बारे में चिंतित है। उसने आगे कहा कि यह पश्चिम बंगाल राज्य में जबरदस्ती और धमकी के माध्यम से मीडिया की आवाज़ दबाने का प्रयास है।
आयोग ने पाया है कि आरोप पत्रकार के मानव अधिकारों के उल्लंघन और प्रेस की स्वतंत्रता पर प्रतिबंध का गंभीर मुद्दा उठाते हैं। तदनुसार, आयोग ने पश्चिम बंगाल के पुलिस महानिदेशक को नोटिस जारी किया है और उन्हें दो सप्ताह के भीतर मामले में रिपोर्ट सौंपने का निर्देश दिया है। आयोग ने अपने डीआइजी (अन्वेभषण) को दूरभाष पर तथ्यों का पता लगाने और एक सप्ताह के भीतर आयोग को अपनी रिपोर्ट सौंपने के लिए भी कहा है।
नोटिस जारी करते हुए, एनएचआरसी ने हाल ही में एक मामले में उच्च<तम न्याायालय की टिप्पणी पर भी गौर किया है कि "लोकतांत्रिक गणराज्य के मजबूत कामकाज के लिए एक स्वतंत्र प्रेस महत्वपूर्ण है। एक लोकतांत्रिक समाज में इसकी भूमिका महत्वपूर्ण है क्योंकि यह राज्य के कामकाज पर प्रकाश डालती है। प्रेस का कर्तव्य है कि वह सत्ता के सामने सच बोले और नागरिकों को ठोस तथ्य पेश करे ताकि वे ऐसे विकल्प चुन सकें, जो लोकतंत्र को सही दिशा में ले जाएं। प्रेस की स्वतंत्रता पर प्रतिबंध नागरिकों को एक समान दृष्टिकोण से सोचने के लिए मजबूर करता है। सामाजिक-आर्थिक नीति से लेकर राजनीतिक विचारधाराओं तक के मुद्दों पर एक समान दृष्टिकोण लोकतंत्र के लिए गंभीर खतरे पैदा करेगा।"

The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a complaint that Shri Santu Pan, a journalist of Republic Bangla TV was unlawfully detained while covering crimes against women in Sandeshkhali, West Bengal on 19th February, 2024. Allegedly, without any prior notice, the police personnel encircled the victim, assaulted and forcefully took him into illegal custody. The complainant being the wife of the journalist has also alleged that she has no access to him and is concerned about his well-being. She has further submitted that this is an attempt to throttle the media through coercion and intimidation in the State of West Bengal.
The Commission has observed that the allegations raise a serious issue of violation of his human rights and also restriction on the freedom of the press. Accordingly, it has issued a notice to the Director General of Police (DIG), West Bengal directing him to submit a report in the matter within two weeks. The Commission has also asked its DIG (Investigation) to find out the facts by telephone and submit his findings to the Commission within a week.
Issuing the notice, the NHRC has also noted the observation of the Supreme Court in a recent case that "An independent press is vital for the robust functioning of a democratic republic. Its role in a democratic society is crucial for it shines a light on the functioning of the State. The press has a duty to speak truth to power, and present citizens with hard facts enabling them to make choices that propel democracy in the right direction. The restriction on the freedom of the press compels citizens to think along the same tangent. A homogenized view on issues that range from socio-economic policy to political ideologies would pose grave dangers to democracy."

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया कि मुंबई हवाई अड्डे पर एक 80 वर्षीय व्यक्ति की मृत्यु हो गई क्योंकि एयरलाइन से पूर्व अनुरोध करने के बावजूद उसे व्हीलचेयर उपलब्ध नहीं कराए जाने के कारण उसे पैदल चलना पड़ा। कथित तौर पर, भारतीय मूल के अमेरिकी पासपोर्ट धारक को अपनी पत्नी के साथ पैदल चलना पड़ा, लेकिन आप्रवासन क्षेत्र के रास्ते में लगभग 1.5 किलोमीटर चलने के बाद वह गिर गया।
आयोग ने पाया है कि मीडिया रिपोर्ट की सामग्री, यदि सच है, तो यह पीड़ित के मानव अधिकारों के उल्लंघन का गंभीर मुद्दा है। तदनुसार, आयोग ने नागरिक उड्डयन महानिदेशालय को नोटिस जारी कर 4 सप्ताह के भीतर मामले में विस्तृत रिपोर्ट मांगी है। इसमें मृतक के निकटतम सम्बन्धी को प्रदान किए गए मुआवजे की स्थिति, यदि कोई हो, शामिल होनी चाहिए। आयोग यह भी जानना चाहेगा कि ऐसी घटनाओं की पुनरावृत्ति न हो, यह सुनिश्चित करने के लिए क्या कदम उठाए गए/उठाए जाने का प्रस्ताव है।
नोटिस जारी करते हुए आयोग ने यह भी पाया है कि हवाई यात्रियों की संख्या के साथ-साथ हवाई किराए में भी उल्लेखनीय वृद्धि हुई है लेकिन सुविधाओं के मानक में आनुपातिक रूप से सुधार नहीं हुआ है, जिसके परिणामस्वरूप मीडिया में कई शिकायतें दर्ज की गईं और सोशल मीडिया पर पोस्ट की गईं।
मीडिया रिपोर्ट के मुताबिक, उस फ्लाइट में 32 व्हीलचेयर यात्री थे, लेकिन वहां उनकी मदद के लिए केवल 15 कर्मचारी ही मौजूद थे। पत्नी व्हीलचेयर पर बैठी थी तथा उसका पति उसके पीछे पैदल चल रहा था और कुछ देर बाद वह गिर गया। बुजुर्ग दंपत्ति न्यूयॉर्क से भारत की यात्रा हेतु आए थे।

Issues notice to the Directorate General of Civil Aviation calling for a report in four weeks
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report that an 80-year-old man died at the Mumbai airport as he had to walk when not provided with a wheelchair despite prior request to the airline. Reportedly, the man of Indian origin having a US Passport had to walk alongside his wife in another wheelchair but collapsed after walking about 1.5 kilometres on the way to the immigration area.
The Commission has observed that the contents of the media report, if true, raise a serious issue of violation of human rights of the victim. Accordingly, it has issued notice to the Directorate General of Civil Aviation calling for a detailed report in the matter within 4 weeks. It should include the status of compensation if any, provided to the Next of Kin of the deceased. The Commission would also like to know the steps taken/ proposed to be taken to ensure that such incidents do not recur.
Issuing the notice, the Commission has also observed that there has been a significant increase in the number of air passengers as well as the airfare but the standard of facilities doesn’t seem to have improved proportionately resulting in several complaints reported in the media and posted on social media.
According to the media report, there were 32 wheelchair passengers on the particular flight but there were only 15 available with accompanying staff on the ground to help them. The wife sat in the wheelchair while the husband followed her on foot and collapsed after some time. The elderly couple was travelling from New York to India.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया है कि एक महिला ने मध्य प्रदेश के इंदौर में अपने 2, 3, 7, 8 और 10 वर्ष की आयु के पांच बच्चों को भीख मांगने के लिए मजबूर करके प्लॉ ट, एक दो मंजिला घर, एक मोटरसाइकिल, 20,000 रुपये का स्मार्टफोन खरीदा तथा छह सप्ताह में 2.5 लाख रुपये एकत्र किए। कथित तौर पर, वह महिला उन सभी बच्चों7 को महाकाल मंदिर की ओर जाने वाले विभिन्न रास्तोंम पर भीख मांगने के लिए मजबूर कर रही थी।
आयोग ने पाया है कि मीडिया रिपोर्ट की सामग्री, यदि सही है, तो यह बच्चों के मानव अधिकारों का घोर उल्लंघन है। इस मामले में गिरफ्तार की गई महिला कथित तौर पर बार-बार अपराध करने वाली है, जो यह दर्शाता है कि राज्यह में संबंधित अधिकारी सतर्क नहीं हैं, जिसके कारण छोटे बच्चे यहां तक कि अपने परिवार के सदस्यों द्वारा भी उत्पीड़न का शिकार हो रहे हैं। जिस उम्र में छोटे बच्चों को स्कूल जाना चाहिए और अपनी पढ़ाई और करियर पर ध्यान केंद्रित करना चाहिए, उस उम्र वे जीवन जीने के अनैतिक तरीके अपनाने के लिए मजबूर होते हैं।।
तदनुसार, आयोग ने मध्य प्रदेश सरकार के मुख्य सचिव को नोटिस जारी कर 4 सप्ताह के भीतर मामले में विस्तृत रिपोर्ट मांगी है। रिपोर्ट में, ऐसी घटनाओं की पुनरावृत्ति न हो, यह सुनिश्चित करने के लिए उठाए गए/उठाए जाने वाले प्रस्तावित कदम शामिल होने चाहिए। राज्य के अधिकारियों को किशोर न्याय अधिनियम के प्रावधानों के अनुसार छोटे बच्चों के संबंध में की गई कार्रवाई के बारे में सूचित करने का भी निर्देश दिया गया है, जिसमें यदि आवश्यक हो तो उन्हेंा सेफ कस्टिडी में परामर्श प्रदान करना भी शामिल है।।
आयोग यह जानना चाहेगा कि क्या भिखारियों की संख्या, उनके खिलाफ की गई कार्रवाई और उनके पुनर्वास के लिए उठाए गए कदमों का पता लगाने के लिए राज्य सरकार द्वारा हाल ही में कोई सर्वेक्षण किया गया है।।
आयोग ने नोटिस जारी करते हुए यह भी कहा है कि राष्ट्रीय स्तर पर कोई भीख निवारण कानून नहीं है। हालाँकि, विभिन्न राज्यों ने भीख मांगने की कुप्रथा से निपटने के लिए कानून पारित किए हैं। मध्य प्रदेश राज्य ने "एमपी भिक्षा वृत्ति निवारण अधिनियम, 1973" को पारित किया और लागू किया है। यह कानून मध्य प्रदेश राज्य में भीख मांगने की रोकथाम, हिरासत, भिखारियों और उनके आश्रितों को प्रमाणित संस्थानों में प्रशिक्षण और रोजगार तथा भिखारी अपराधियों की हिरासत, ट्रायल और सजा का प्रावधान करता है। इसलिए, कानून को सख्ती से लागू करने की आवश्यकता है ताकि बच्चे असामाजिक तत्वों का आसान शिकार न बनें।।
दिनांक 13 फरवरी, 2024 को जारी मीडिया रिपोर्ट के अनुसार, महिला को पुलिस ने दिनांक 12.02.2024 को गिरफ्तार कर लिया और रिमांड पर जेल भेज दिया। उनकी 7 साल की बेटी को अधिकारियों ने एक एनजीओ की देखभाल में भेज दिया है।।

NHRC notice to the Government of Madhya Pradesh over the media reports about a woman earning lakhs by forcing her children to beg in Indore
Report sought within four weeks in the matter including care provided to the minor children as per the JJ Act
It is expected to include the action taken to stop the recurrence of such incidents with strict enforcement of the anti-begging law of the State
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report that a woman bought a plot of land, a two-storied house, a motorcycle, smartphone worth Rs. 20,000 and Rs. 2.5 lakh in six weeks by forcing her five children aged between 2, 3, 7, 8 and 10 to beg in Indore, Madhya Pradesh. Reportedly, all of them were being forced by her to beg at different locations proceeding towards Mahakal Temple.
The Commission has observed that the contents of the media report, if true, amount to a violation of human rights. The woman arrested in the instant case is reportedly a repeat offender which indicates that the authorities concerned are not vigilant due to which the young children are being victimized even by their family members. At an age when young children have to attend schools and concentrate on their studies and careers, they are forced to adopt unethical ways of living.
Accordingly, it has issued notices to the Chief Secretary, Government of Madhya Pradesh calling for a detailed report in the matter within 4 weeks. The report should include steps taken/ proposed to be taken to ensure that such incidents do not recur. The State authorities are also directed to inform about the action taken with regard to the young children as per the provisions of the Juvenile Justice Act including providing counseling in safe custody if required.
The Commission would like to know whether any survey has been recently conducted by the State government to find out the number of beggars, action taken against them as well as steps taken for their rehabilitation.
While issuing the notice, the Commission has also noted that there is no anti-begging law at the national level. However, different states have passed laws to deal with the vicious practice of begging. The State of Madhya Pradesh has passed and adopted "The M.P. Bhiksha Vritti Nivaran Adhiniyam, 1973". The law provides for the prevention of begging, detention, training and employment of beggars and their dependents, in certified institutions and for the custody, trial and punishment of beggar offenders in the State of Madhya Pradesh. Therefore, there is a need for a strict implementation of the law so that children do not become easy prey for the anti-social elements.
According to the media report, carried on 13th February, 2024, the woman was arrested by the police and sent to jail on remand on 12.02.2024. Her daughter, aged 7 years has been put in the care of an NGO by the authorities.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक अखबार के लेख का स्वत: संज्ञान लिया है कि भारत में पूरी तरह से अलग-अलग बीमारियों के इलाज के लिए समान ब्रांड नामों के साथ बड़ी संख्या में दवाएं बेची जा रही हैं। कथित तौर पर, फार्मेसी में इन दवाओं के नामों में भ्रम के परिणाम मरीजों के लिए गंभीर हो सकते हैं क्योंकि ये दवाएं डॉक्टरों द्वारा विभिन्न बीमारियों के इलाज के लिए लिखी जा रही हैं। कथित तौर पर, केंद्रीय औषधि मानक नियंत्रण संगठन (सीडीएससीओ) को सबसे पहले प्रत्येक राज्य और केंद्र शासित प्रदेश में 36 अलग-अलग दवा नियंत्रकों से डेटा एकत्र करके सभी फार्मास्युटिकल ब्रांड नामों का एक डेटाबेस बनाना होगा क्योंकि देश में ऐसा कोई डेटाबेस नहीं है। इसके अलावा, प्राधिकारियों द्वारा प्रिस्क्रिप्शन त्रुटियों के संबंध में कोई डेटा नहीं रखा जा रहा है।
आयोग ने पाया है कि लेख की सामग्री, यदि सत्य है, तो यह मानव अधिकार का गंभीर मुद्दा है। तदनुसार, आयोग ने केंद्रीय स्वास्थ्य एवं परिवार कल्याण मंत्रालय के सचिव और भारत के औषधि महानियंत्रक को नोटिस जारी कर इस मुद्दे के समाधान के संबंध में 4 सप्ताह के भीतर विस्तृत रिपोर्ट मांगी है।
25 जनवरी, 2024 को प्रकाशित अखबार के लेख में ऐसी कई दवाओं के उदाहरण दिए गए हैं जिनके नाम समान हैं लेकिन उन्हें विभिन्न बीमारियों के इलाज के लिए निर्धारित किया जा रहा है। 'लिनमैक 5' नाम की एक दवा का उपयोग मल्टीपल मायलोमा के इलाज के लिए किया जाता है, जो एक प्रकार का कैंसर है और 'लिनमैक' नाम की दूसरी दवा का उपयोग मधुमेह के इलाज के लिए किया जाता है।
कथित तौर पर, 'मेडज़ोल' ब्रांड नाम के तहत बेची जा रही एक अन्य दवा का उपयोग चार अलग-अलग कंपनियों द्वारा चार अलग-अलग सक्रिय अवयवों को बेचने के लिए किया जाता है, जो पूरी तरह से अलग-अलग बीमारियों का इलाज करती हैं। पहली कंपनी 'मेडज़ोल' का उपयोग 'मिडाज़ोलम' युक्त दवा बेचने के लिए करती है जिसका उपयोग शामक के रूप में किया जाता है। दूसरी कंपनी डोमपरिडोन और पैंटोप्राजोल का संयोजन बेचने के लिए 'मेडज़ोल-डीएसआर' नाम का उपयोग करती है जिसका उपयोग पेट की एसिडिटी के इलाज के लिए किया जाता है। एक तीसरी कंपनी एल्बेंडाजोल युक्त फॉर्मूलेशन के लिए 'मेडज़ोल 400' नाम का उपयोग करती है जिसका उपयोग बच्चों के कृमिनाशक उपचार में किया जाता है। चौथी कंपनी इट्राकोनाजोल युक्त फॉर्मूलेशन के लिए 'मेडज़ोल 200' का उपयोग करती है, जो एक शक्तिशाली एंटीफंगल दवा है जिसका उपयोग "ब्लैक फंगस" जैसी बीमारियों के इलाज के लिए किया जाता है।
यह लेख, आगे एक और समस्या के बारे में बात करता है, यानी कंपनियों द्वारा समान व्यापार नामों का उपयोग जो सुनने और देखने में समान लगते हैं। एक उदाहरण का हवाला देते हुए कहा गया है कि जहां एक कंपनी पैरासिटामोल बेचने के लिए 'मेडपोल' ब्रांड का उपयोग करती है, वहीं दूसरी कंपनी कॉर्टिकोस्टेरॉइड बेचने के लिए 'मेड्रोल' ब्रांड का उपयोग करती है और तीसरी कंपनी एंटीबायोटिक बेचने के लिए 'मेट्रोज़ोल' ब्रांड का उपयोग करती है। ये नाम सुनने में 'मेडज़ोल' के समान लगते हैं और केवल एक या दो अक्षरों के प्रतिस्थापन के साथ एक-दूसरे के समान भी हैं।
इतना ही नहीं, एक और गंभीर समस्या एक ही कंपनी द्वारा गर्भनिरोधक के रूप में विभिन्न सक्रिय तत्वों को बेचने के लिए एक जैसे अथवा समान नामों के उपयोग से संबंधित पाई गई है।

NHRC takes suo motu cognizance of a newspaper article on a large number of drugs being sold in India with identical brand names for treating entirely different ailments
Issues notices to the Secretary, Union Ministry of Health & Family Welfare and the Drugs Controller General of India
Reports expected within four weeks
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a newspaper article that a large number of drugs are being sold in India with identical brand names for treating entirely different conditions. Reportedly, the consequences of confusion between these medications at the pharmacy can be serious for patients as these drugs are being prescribed by the doctors for treatment of different diseases. Reportedly, the Central Drugs Standard Control Organization (CDSCO) would first have to build a database of all pharmaceutical brand names by collecting data from the 36 different Drug Controllers in each State and Union Territory as there is no such database in the country. Also, no data on prescription errors is being maintained by the authorities.
The Commission has observed that the contents of the article, if true, amount to a serious issue of human rights. Accordingly, it has issued notices to the Secretary, Union Ministry of Health & Family Welfare and the Drugs Controller General of India calling for a detailed report in the matter within 4 weeks. It should include steps taken/proposed to be taken to address the issue.
The newspaper article, carried on 25th January, 2024, has given examples of many such drugs having identical names but being prescribed for treating different ailments. A drug with the name ‘Linamac 5’ is used to treat multiple myeloma, which is a type of cancer and the other drug bearing the name 'Linamac' is used to treat diabetes.
Reportedly, another medicine being sold under the brand name ‘Medzole’, is used by four different companies to sell four different active ingredients, treating entirely different medical conditions. The first company uses 'Medzol' to sell a drug containing ‘Midazolam’ which is used as a sedative. The second company uses the name 'Medzole-DSR' to sell a combination of domperidone and pantoprazole which is used to treat stomach acidity. A third company uses the name 'Medzole 400' for a formulation containing albendazole that is used in deworming treatment for children. A fourth company uses 'Medzole 200' for a formulation containing Itraconazole, which is a powerful antifungal drug used to treat diseases such as "black fungus".
The article, further speaks about another problem i.e. use of similar trade names by companies which seem to be phonetically and visually similar. Quoting an example it is stated that while one company uses the brand 'Medpol' to sell paracetamol, a second company uses the brand 'Medrol' to sell a corticosteroid and a third company uses 'Metrozole' to sell an antibiotic. These names sound phonetically similar to 'Medzole' and also similar to each other with only a letter or two substituted.
Not only this, another serious problem has been identified relating to the use of identical or similar names to sell different active ingredients as contraceptives by the same company itself.

आयोग दोषी और लापरवाह अधिकारियों के खिलाफ कार्रवाई और ऐसी घटनाओं की पुनरावृत्ति को रोकने के लिए उठाए गए कदमों के बारे में भी जानना चाहेगा
राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया है रिपोर्ट के अनुसार 6 फरवरी 2024 को मध्य प्रदेश के हरदा जिले के बाहरी इलाके में एक पटाखा फैक्ट्री में सिलसिलेवार विस्फोटों में लगभग 11 लोगों की मौत हो गई और लगभग 200 लोग घायल हो गए। धमाके का असर फैक्ट्री के आसपास कई किलोमीटर तक के इलाकों में महसूस किया गया। कथित तौर पर, वायरल वीडियो में पीड़ितों के शव सड़कों और खेतों में बिखरे हुए पाए गये हैं।
आयोग ने पाया है कि मीडिया रिपोर्ट की सामग्री, यदि सच है, तो यह मानव अधिकारों का उल्लंघन है। तदनुसार, आयोग ने मध्य प्रदेश के मुख्य सचिव और पुलिस महानिदेशक को नोटिस जारी कर चार सप्ताह के भीतर मामले में विस्तृत रिपोर्ट मांगी है।
रिपोर्ट में एफआईआर की स्थिति, विस्फोट के पीड़ितों और उनके पीड़ित परिवारों को प्रदान किए गए स्वास्थ्य और चिकित्सा उपचार की अद्यतन जानकारी अपेक्षित है । आयोग दोषी और लापरवाह अधिकारियों के खिलाफ कार्रवाई और ऐसी घटनाओं की पुनरावृत्ति को रोकने के लिए उठाए गए कदमों के बारे में भी जानना चाहेगा।
7 फरवरी, 2024 की मीडिया रिपोर्ट के मुताबिक, फैक्ट्री में 32 हॉल थे जो विस्फोटकों से भरे हुए थे, जिनमें ज्यादातर सुतली बम थे। जब सिलसिलेवार विस्फोट हुए तो फैक्ट्री में 200 से अधिक लोग काम करते थे, जिनमें से लगभग 70 लोग सुबह की पाली में काम करते थे। यह फैक्ट्री पहले भी कुछ अवैधताओं के चलते जांच के दायरे में रही है। वर्ष 2015 में फैक्ट्री के अंदर हुए विस्फोट में दो श्रमिकों की मौत के बाद वर्ष 2022 में इसे बंद करने का आदेश दिया गया था और वर्ष 2021 में मालिक को 10 साल की कैद की सजा सुनाई गई थी, लेकिन उन्होंने आदेश को चुनौती दी थी।

Detailed report sought within four weeks including action against the negligent officers and steps taken to prevent recurrence of such incidents
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report that about 11 people died and nearly 200 were injured in a series of explosions at a fireworks factory in the outskirts of Harda district in Madhya Pradesh on 6th February, 2024. The impact of the blast was felt several kilometres around the factory in the nearby areas. Reportedly, viral video showed victim’s bodies scattered on the roads and in the fields.
The Commission has observed that the contents of the media report, if true, amount to a violation of human rights. Accordingly, it has issued notices to the Chief Secretary and the Director General of Police, Madhya Pradesh calling for a detailed report in the matter within four weeks.
The report is expected to include the status of the FIR, updated information on health and medical treatment provided to the victims of the blast and their aggrieved families. The Commission would also like to know about the action against the erring and negligent officers and the steps taken to prevent recurrence of such incidents.
According to the media report, carried on 7th February, 2024, the factory had 32 halls which were packed with explosives, mostly sutli bombs. Over 200 people worked in the factory with 70 odd in the morning shift when the series of blasts occurred. The factory has been under the scanner earlier also for certain illegalities. It was ordered to be closed in the year 2022 and the owner was sentenced to 10 years of imprisonment in the year 2021 after the death of two workers in a blast which had taken place in 2015, inside the factory but he challenged the order.

इस मामले में चार सप्ताह में रिपोर्ट मांगी गई है, साथ ही रिपोर्ट में ऐसी घटनाओं को रोकने हेतु की गई कार्रवाई भी शामिल हो
राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया है कि बिहार के पश्चिम चंपारण जिले के बांसगांव परसौनी में एक सरकारी माध्यकमिक विद्यालय के 184 छात्र 5 फरवरी 2024 को मध्याह्न भोजन के उपरांत बीमार पड़ गए। कथित तौर पर, छात्रों ने भोजन से केरोसिन तेल की गंध आने की शिकायत की। उन्होंने पेट दर्द और उल्टी की भी शिकायत की, जिसके बाद उन्हें विभिन्नन अस्पतालों में ले जाया गया।
आयोग ने पाया है कि मीडिया रिपोर्ट की सामग्री, यदि सही है, तो यह छात्रों के मानव अधिकारों का गंभीर उल्लंघन है। रिपोर्ट की गई घटना स्कूल अधिकारियों की ओर से पर्यवेक्षी चूक की ओर इशारा करती है, जिसके कारण शायद अस्वास्थ्यकर भोजन तैयार किया गया और बच्चों को परोसा गया।
तदनुसार, आयोग ने बिहार सरकार के मुख्य सचिव को नोटिस जारी कर 4 सप्ताह के भीतर मामले में विस्तृत रिपोर्ट मांगी है। रिपोर्ट में यह सुनिश्चित करने के लिए उठाए गए/उठाए जाने वाले प्रस्तावित कदम भी शामिल होने चाहिए, जिससे ऐसी घटनाओं की पुनरावृत्ति न हो। आयोग यह जानना चाहता है कि क्या उक्तन स्कूल द्वारा सरकारी दिशानिर्देशों का पालन किया जा रहा है, यदि नहीं, तो लापरवाही के लिए जिम्मेदार अधिकारियों/कर्मचारियों के खिलाफ क्या कार्रवाई की गई है।
नोटिस जारी करते हुए, आयोग ने कहा है कि मध्याह्न भोजन तैयार करने और परोसने के लिए स्कूल की रसोई में खाद्य सुरक्षा और स्वच्छता के बारे में भारत सरकार द्वारा सभी राज्यों और केंद्र शासित प्रदेशों को कुछ दिशानिर्देश जारी किए गए हैं। बच्चों को भोजन परोसने से पहले शिक्षक द्वारा भोजन को चखना और उसका रिकॉर्ड रखना भी अनिवार्य है।
6 फरवरी, 2023 को आई मीडिया रिपोर्ट के अनुसार, छात्रों को बेतिया सरकारी मेडिकल कॉलेज एवं अस्पताल तथा सरकारी उप-विभागीय अस्पताल बगहा ले जाया गया। स्कूल के हेडमास्टर को हिरासत में लिया गया है।

Report sought in four weeks in the matter as well as the action taken to prevent such incidents
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report that 184 students of a government-run middle school at Bansgaon Parsauni in West Champaran District of Bihar fell ill after consuming Mid-Day-Meal on 5th February, 2024. Reportedly, the students complained of getting the smell of kerosene oil from the meal. They also complained of stomach aches and vomiting after which they were taken to the hospitals.
The Commission has observed that the contents of the news report, if true, amount to a serious violation of the human rights of the students. The reported incident indicates towards supervisory lapse on the part of the school authorities perhaps due to which unhygienic food was prepared and served to the children.
Accordingly, the Commission has issued a notice to the Chief Secretary, Government of Bihar calling for a detailed report in the matter within 4 weeks. It should include the steps taken/ proposed to be taken to ensure that such incidents do not recur. The Commission would like to know whether the Government guidelines are being followed by the particular school, if not, then what action has been taken against the officers/officials responsible for the negligence.
Issuing the notice, the Commission has noted that there are certain guidelines issued by the Government of India to all the States and Union Territories about food safety and hygiene in school kitchens for preparing and serving Mid-Day Meal. The tasting of the food and maintaining its record by a teacher is also mandatory before serving it to the children.
According to the media report, carried on 6th February, 2023 students were taken to the Bettiah Government Medical College and Hospital and Government Sub-Divisional Hospital Bagaha. The Headmaster of the school has been detained.

आयोग ने विद्यालय शिक्षा आयुक्त से कल्याणकारी उपाय के रूप में मुफ्त किताबें उपलब्ध कराने और शुल्क माफ करने को कहा
राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत के हस्तक्षेप के परिणामस्वरूप विशेष रूप से कमजोर आदिवासी समूहों के गरीब बच्चों को विद्यालय की सुविधाएं मिल रही हैं और आंध्र प्रदेश के अल्लूरी सीतारमा राजू जिले के जजुलाबांधा गांव में उनका शिक्षा का अधिकार सुनिश्चित हुआ है। आयोग ने गांव में आदिवासी बच्चों के लिए विद्यालय की कमी के बारे में एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया था और राज्य सरकार को नोटिस जारी किया था।
नोटिस के जवाब में जिला प्रशासन ने जांच कराई तो मीडिया रिपोर्ट में लगे आरोप सही पाए गए। प्रशासन ने आयोग को सूचित किया है कि तत्काल अंतरिम उपाय के रूप में, गांव में एक विद्यालय के लिए एक अस्थायी शेड प्रदान किया गया है और समायोजन के आधार पर पास के एमपीपी विद्यालय से एक शिक्षक को तैनात किया गया है। मध्याह्न भोजन और पेयजल की भी व्यवस्था की गई है।
इन अंतरिम उपायों को करते हुए, जिला प्रशासन ने विद्यालय शिक्षा आयुक्त, आंध्र प्रदेश से इन गरीब आदिवासी बच्चों को शिक्षा प्रदान करने हेतु एक नए प्राथमिक विद्यालय के निर्माण को मंजूरी देने या जजुलाबांधा गांव में एक गैर-आवासीय विशेष प्रशिक्षण केंद्र (एनआरएसटीसी) खोलने की अनुमति देने का भी अनुरोध किया है।
आयोग ने आंध्र प्रदेश के विद्यालय शिक्षा आयुक्त से राज्य द्वारा कल्याणकारी उपाय के रूप में गांव के छात्रों को मुफ्त विद्यालय किताबें प्रदान करने, विद्यालय फीस माफ करने आदि के लिए कहा है।
यहां यह उल्लेख किया जाता है कि दिनांक 1 जून, 2023 को, एनएचआरसी, भारत ने 31 मई, 2023 की एक मीडिया रिपोर्ट का स्वत: संज्ञान लिया था कि अनुरोधों के बावजूद अधिकारी आंध्र प्रदेश में अल्लुरी सीतारमा राजू (एएसआर) जिले के जजुलाबांधा आदिवासी बस्ती में कोई विद्यालय स्थापित नहीं कर पाए हैं। यह बताया गया कि चूँकि बच्चे विद्यालय जाने के लिए जंगल में छह किलोमीटर उबड़-खाबड़ इलाके से होकर नहीं जा सकते थे, इसलिए उन्होंने विद्यालय जाने के बजाय अपने माता-पिता के साथ काम करना पसंद किया।
कथित तौर पर, 30 मई, 2023 को, बच्चों और उनके माता-पिता ने अधिकारियों पर दबाव डालने के लिए हाथ जोड़कर एक अनूठा प्रदर्शन किया कि यदि उनके गांव में विद्यालय नहीं खोला जा सकता है, तो कम से कम फिलहाल एक सरकारी शिक्षक नियुक्त कर दिया जाए क्योंकि एक गैर सरकारी संगठन ने कथित तौर पर एस्बेस्टस शीट से बना एक अस्थायी विद्यालय खोला है तथा किताबें एवं ब्लैकबोर्ड उपलब्ध कराए हैं।
गंभीर चिंता व्यक्त करते हुए, आयोग ने आंध्र प्रदेश सरकार के मुख्य सचिव को नोटिस जारी किया था, जिसमें मीडिया रिपोर्ट में उठाए गए मुद्दे के समाधान के लिए उठाए गए/उठाए जाने वाले प्रस्तावित कदमों सहित एक विस्तृत रिपोर्ट मांगी गई थी।
इसके बाद, जिला प्रशासन ने जांच की और मीडिया रिपोर्ट की सामग्री को सही पाया। जांच से पता चला कि गांव में विद्यालय जाने वाले बच्चों की कुल संख्या 42 थी। उनमें से 10 गांव से दूर, कुमरलाबांधा स्थित एमपीपी विद्यालय में पढ़ रहे थे। उन्हें बिना किसी उचित रास्ते के घने जंगल, जो जंगली जानवरों का घर है, से होकर गुजरना पड़ता है, जिसमें बरसात के मौसम में एक छोटी सी धारा को पार करना भी शामिल है। 18 अन्य बच्चे अलग-अलग स्कूलों में पढ़ रहे थे, जबकि इस वर्ष 5+ उम्र के 14 बच्चों का विद्यालय में नामांकन होना है।

District administration sets up a temporary shed with water and mid-day meal facilities besides deputing a teacher as an interim measure

The intervention by the National Human Rights Commission, NHRC, India has resulted in the poor children of particularly vulnerable tribal groups getting school facilities and their right to education is ensured at Jajulabandha village in the Alluri Sitharama Raju district of Andhra Pradesh. The Commission had taken suo motu cognizance of a media report about the lack of school for the tribal children in the village and had issued a notice to the state government.
In response to the notice, the district administration conducted an enquiry and found the allegations in the media report true. It has informed the Commission that as an immediate interim measure, a temporary shed has been provided for a school in the village and a teacher has been deputed from nearby MPP School on an adjustment basis. Arrangements have also been made for the mid-day meal and drinking water.
While making these interim measures, the district administration has also requested the Commissioner of School Education, Andhra Pradesh to sanction the construction of a new primary school or accord permission to open a Non-Residential Special Training Centre (NRSTC) at Jajulabandha village to provide education to the poor tribal children.
The Commission has asked the Commissioner of School Education, Andhra Pradesh to provide free school books, waive school fees, etc. to the students of the village as a welfare measure by the state.
It may be recalled that on 1st June, 2023, the NHRC, India had taken suo motu cognizance of a media report dated 31st May, 2023 that despite requests the authorities have not been able to set up any school in the Jajulabandha tribal hamlet in Alluri Sitharama Raju (ASR) district of Andhra Pradesh. It was reported that as the children could not take a walk through six kilometres of rough terrain in the forest to attend school, they preferred to work along with their parents.
Reportedly, on 30th May, 2023, the children and their parents staged a novel demonstration with folded hands to impress upon the authorities to at least allocate a government teacher for the time being if not set up a school in their village as an NGO had reportedly set up a makeshift school with asbestos sheet and provided books and blackboards.
Expressing serious concern, the Commission had issued a notice to the Chief Secretary, Government of Andhra Pradesh calling for a detailed report including the steps taken/proposed to be taken to address the issue raised in the news report.
Thereafter, the district administration conducted an enquiry and found the contents of the news report true. The enquiry revealed that the village had a total number of 42 school-age children. Out of them, 10 were attending MPP School, Kummarlabandha, far away from the village. They have to walk through a dense forest having animals and without any proper path involving crossing a small stream in the rainy season. 18 other children were studying in different schools even as 14 children of 5+ age are to be enrolled in the school this year.

जेलों, पुलिस स्टेशनों और सरकारी/एनजीओ द्वारा संचालित कुछ आश्रय गृहों की कार्यप्रणाली को समझने के लिए वर्चुअल दौरा भी इंटर्नशिप का हिस्सा होगा
राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत द्वारा आज इस कैलेंडर वर्ष की पहली और वित्तीय वर्ष 2023-24 की चौथी ऑनलाइन शॉर्ट टर्म इंटर्नशिप शुभारंभ किया गया। इसका उद्घाटन करते हुए अध्यक्ष न्यायमूर्ति श्री अरुण मिश्रा ने कहा कि जन्म से सभी मनुष्य समान हैं। मानव अधिकार वे अविभाज्य अधिकार हैं जो मनुष्य को उसके जन्म से ही प्राप्त होते हैं। हालाँकि, जैसा कि महात्मा गांधी ने कहा था, ये अधिकार केवल हमारे कर्तव्यों का निर्वहन करके प्राप्त किए जा सकते हैं और कोई भी अधिकार कर्तव्यों के बिना नहीं आता है।
न्यायमूर्ति मिश्रा ने कहा कि हमें हाशिये के वर्गों को समाज की मुख्यधारा में आने और अन्य लोगों की तरह विशेषाधिकारों और अधिकारों का उपभोग करने में मदद करनी चाहिए। उन्होंने कहा कि सतत विकास लक्ष्य हासिल करना ही आगे बढ़ने का रास्ता है। तकनीकी प्रगति ने मानव जीवन को कई फायदे तो दिए हैं लेकिन साथ ही नुकसान भी पहुंचाए हैं। साइबरस्पेस के दुरुपयोग के कारण साइबर अपराध और मानव दुर्व्यापार सहित मानव अधिकारों का उल्लंघन हो रहा है। उन्होंने कहा कि इंटर्नशिप का उद्देश्य विषय विशेषज्ञेां की मदद से युवा पीढ़ी को जलवायु परिवर्तन सहित मानवता के सामने आने वाली इन सभी चुनौतियों से अवगत कराना और मानव अधिकारों के संवर्धन और संरक्षण के लिए काम करना है।
एनएचआरसी, भारत के महासचिव, श्री भरत लाल ने आशा व्यक्त की कि प्रशिक्षु मानव अधिकारों के महत्व को समझने और जागरूकता फैलाने के लिए इस इंटर्नशिप का सर्वोत्तम उपयोग करेंगे। जिन छात्रों को इस कार्यक्रम में भाग लेने के लिए चुना गया है, उन्हें इसे एक दुर्लभ अवसर के रूप में लेना चाहिए। छात्रों को विषय विशेषज्ञों द्वारा मानव अधिकार संबंधी मुद्दों के विभिन्न पहलुओं से अवगत कराया जाएगा, इसके अलावा जेलों, पुलिस स्टेशनों और सरकार/एनजीओ द्वारा संचालित कुछ आश्रय गृहों सहित विभिन्न संस्थानों की कार्यप्रणाली को समझने के लिए उन्हें वर्चुअल दौरे कराए जायेगें।।
प्रशिक्षुओं का स्वागत करते हुए, संयुक्त सचिव, श्री देवेन्द्र कुमार निम ने इंटर्नशिप का संक्षिप्त विवरण दिया, जो मानव अधिकार जागरूकता के निर्माण के लिए आयोग के एक प्रमुख कार्यक्रम के रूप में विश्वविद्यालय स्तर के विद्यार्थियों के बीच काफी लोकप्रिय है। श्री निम ने प्रशिक्षुओं से अनुरोध किया कि वे उनका लक्ष्य केवल प्रमाण-पत्र प्राप्त करना न हो, बल्कि वे मानव अधिकारों के मशाल वाहक बनें और मानव अधिकारों के संवर्धन और संरक्षण के लिए एनएचआरसी और कमजोर एवं हाशिए के समुदायों के बीच एक सेतु बनें। उन्होंने आशा व्यक्त की कि प्रशिक्षु किसी भी सत्र में अनुपस्थित नहीं रहेंगे और उन्होंने यह भी बताया कि एनएचआरसी अपने प्रशिक्षण और इंटर्नशिप कार्यक्रमों को एनएएसी और अन्य निकायों से मान्यता प्राप्त कराने के लिए काम कर रहा है। इस अवसर पर रजिस्ट्रार (विधि), श्री सुरजीत डे, संयुक्त सचिव, श्रीमती अनिता सिन्हा और अन्य अधिकारी, जेआरसी तथा अन्य कर्मचारी उपस्थित थे। इसमें देश के विभिन्न हिस्सों से चयनित 94 विद्यार्थी भाग ले रहे हैं।

94 university-level students selected from different parts of the country attending
Interns to be exposed to various aspects of human rights in online sessions by subject experts
Virtual tours to prisons, police stations and some shelter homes run by Govt./NGO are also to be part of the internship to understand their functioning
The National Human Rights Commission, NHRC, India today began this Calendar year’s first and 4th of the financial year 2023-24 Online Short Term Internship. Inaugurating it, Chairperson Justice Shri Arun Mishra said that all human beings are born equal. Human Rights are inalienable rights that a human being is entitled to right since his birth. However, as Mahatma Gandhi said, these rights can be enjoyed only by performing our duties well and that no rights come without duties.
Justice Mishra said we should help the marginalized sections come to the mainstream of society & enjoy the privileges and rights like others. He said achieving Sustainable Development Goals is a way forward. Technological advancements have brought many advantages to human life but not without disadvantages. Misuse of cyberspace is causing human rights violations including, among others, cyber crimes and human trafficking. He said that the purpose of the internship is to make the young generations aware of all these challenges including climate change facing humanity with the help of subject expert speakers and to work for the promotion and protection of human rights.
NHRC, India Secretary General, Shri Bharat Lal expressed the hope that the interns would make the best use of this internship to understand the importance of human rights and further spread awareness. The students who have been selected to attend this programme should take it as a rare opportunity. The students will be exposed to various aspects of human rights-related issues from subject experts besides being taken on virtual tours to various institutions including jails, police stations and some shelter homes run by government/NGOs to understand their functioning.
Welcoming the interns, Joint Secretary, Shri Devendra Kumar Nim gave an overview of the internship, which is much sought after among university-level students as a flagship program of the Commission for building human rights awareness. Shri Nim requested interns not only to aim for certification but also to become torch-bearers of human rights and a bridge between NHRC and vulnerable and marginalized communities for the promotion and protection of human rights. He expected that the interns would not miss out on any of the sessions and also informed that NHRC is working to get its training and internship programs accredited with NAAC and other bodies. Registrar Law, Shri Surajit Dey, Joint Secretary, Smt Anita Sinha and other officers, JRCs and staff were present. 94 students selected from various parts of the country are attending.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत द्वारा 2023 में मानव अधिकारों पर आधारित लघु फिल्मों के लिए आयोजित नौवीं प्रतिष्ठित वार्षिक प्रतियोगिता के विजेताओं की घोषणा की है। आयोग ने 2 लाख रुपये के प्रथम पुरस्कार के लिए फिल्म 'किरण - एक आशा की किरण' (Kiran – A ray of hope) को चुना है। दिल्ली के श्री भूषण अरुण महरे की फिल्म एलजीबीटीक्यूआई+ समुदाय के अधिकारों पर प्रकाश डालती है और उनकी चिंताओं को उठाती है, जिसमें आजीविका कमाने के लिए सम्मान के साथ समान अवसर का अधिकार भी शामिल है। यह फिल्म अंग्रेजी उपशीर्षक के साथ हिंदी और अंग्रेजी में है।
असम के श्री बिभुजल राज कश्यप की लघु फिल्म 'मुखाग्नि- द क्रिमेशन' (Mukhagni – The Cremation) को 1.5 लाख रुपये के द्वितीय पुरस्कार के लिए चुना गया है। एक सच्ची कहानी से प्रेरित यह फिल्म छुआछूत, जातिगत भेदभाव, सामाजिक हठधर्मिता, जाति पंचायत के दबंग फरमान, मृतकों के गरिमापूर्ण अधिकार सहित विभिन्न मुद्दों को उठाती है। यह अंग्रेजी उपशीर्षक के साथ असमिया भाषा में है।
उत्तर प्रदेश के श्री नितिन सोनकर की फिल्म 'स्वतंत्रता का अधिकार' (Right to Freedom) को 1 लाख रुपये के तृतीय पुरस्कार के लिए चुना गया है। फिल्म प्रतीकात्मक रूप से झुग्गी-झोपड़ी में रहने वाले बच्चों के लिए समान अवसरों की वकालत करती है और झुग्गी-झोपड़ी में रहने वाले एक युवा लड़के की कहानी के माध्यम से इस बात पर प्रकाश डालती है कि सपने देखने और जीवन में बड़ा लक्ष्य हासिल करने पर कोई सीमा नहीं होनी चाहिए।
आयोग ने 'विशेष उल्लेख प्रमाणपत्र' के लिए चयनित चार लघु फिल्मों में से प्रत्येक को 50,000/- रुपये का नकद पुरस्कार देने का भी निर्णय लिया है। ये फिल्में हैं:
1. तमिलनाडु के श्री अब्दुल्ला अल्फाज़ीना की फिल्म ‘मानवता का दर्पण’ (Glass of Humanity) है। यह एक मूक फिल्म है और सिनेमाई अभिव्यक्तियों का उपयोग भ्रष्टाचार, भेदभाव और गैरकानूनी प्रथाओं के कारण अधिकारों से इनकार के मुद्दों को उठाती है;
2. त्रिपुरा से श्रीमती सुप्रीति घोष की फिल्म 'दीपशिखा का उत्पीड़न' (Harassment of Deepshikha) है। यह अंग्रेजी उपशीर्षक के साथ बंगाली में है। एक सच्ची कहानी से प्रेरित, यह फिल्म बॉडी शेमिंग और सम्मान और समान अवसरों के साथ जीवन के अधिकार से इनकार के मुद्दे पर प्रकाश डालती है और चिंता जताती है;
3. तमिलनाडु के श्री एम भास्कर की फिल्म 'नारागम - हेल' (Naragam – Hell) है। यह अंग्रेजी उपशीर्षक के साथ तमिल में है। एक सच्ची कहानी से प्रेरित, फिल्म इस बात पर प्रकाश डालती है कि नागरिकों की पहल मानव अधिकारों के उल्लंघन से कैसे बचा सकती है;
4. महाराष्ट्र के श्री राशिद उस्मान निम्बलकर की फिल्म 'रहस' (RAHAS) है। यह एक मूक फिल्म है। यह फिल्म अपनी लोक कलाओं के माध्यम से जीविकोपार्जन करके सम्मानपूर्वक जीवन जीने के अपने अधिकारों को साकार करने में खानाबदोश जनजातियों की चुनौतियों पर प्रकाश डालती है।
एनएचआरसी अध्यक्ष, न्यायमूर्ति श्री अरुण मिश्रा की अध्यक्षता में पूर्ण आयोग जूरी में आयोग के सदस्य, डॉ. ज्ञानेश्वर एम. मुले, श्री राजीव जैन, श्रीमती विजया भारती सयानी, महासचिव, श्री भरत लाल और दो बाहरी विशेषज्ञ, श्री लीला धर मंडलोई, पूर्व महानिदेशक, दूरदर्शन तथा आईआईएमसी से प्रोफेसर रचना शर्मा शामिल थे। वरिष्ठ अधिकारी जो फिल्मों को शॉर्टलिस्ट करने की प्रारंभिक प्रक्रिया का हिस्सा थे, पूर्ण आयोग जूरी के लिए स्क्रीनिंग के दौरान भी उपस्थित थे।
2015 से एनएचआरसी लघु फिल्म पुरस्कार योजना का उद्देश्य मानव अधिकारों के संवर्धन एवं संरक्षण हेतु नागरिकों के सिनेमाई और रचनात्मक प्रयासों को प्रोत्साहित करना और स्वीकार करना है। 2023 में इस प्रतियोगिता के नौवें संस्करण के लिए, देश के विभिन्न हिस्सों से विभिन्न भारतीय भाषाओं में प्राप्त 139 प्रविष्टियों की जांच के बाद कुल 114 लघु फिल्मों को पुरस्कारों के लिए शामिल किया गया था। पुरस्कार प्रस्तुति समारोह बाद में आयोजित किया जाएगा।

The film by Shri Bhushan Arun Mehare from Delhi highlights and raises concerns on LGBTQI+ rights, including among others, the right to equal opportunities with dignity to earn a livelihood. It is in Hindi and English with subtitles in English.
‘Mukhagni- The Cremation’ by Shri Bibhujjal Raj Kashyap from Assam has been selected for the Second prize of Rs. 1.5 lakh. Inspired by a true story, the film raises various issues including untouchability, caste discrimination, social dogmas, overbearing diktat of caste panchayat, right of dignity to the dead. It is in the Assamese language with subtitles in English.
‘Right to freedom’ by Shri Nitin Sonkar from Uttar Pradesh has been selected for the Third prize of Rs. 1 lakh. The film symbolically advocates equal opportunities for the children of slum dwellers and highlights that there should be no cap on dreaming and achieving big in life through the story of a young boy living in a slum.
The Commission has also decided to give a cash award of Rs.50,000/- each to the four short films selected for the ‘Certificate of Special Mention’. These are:
1. ‘Glass of Humanity’ by Shri Abdullah Alfazeena from Tamil Nadu. It is a silent film and using cinematic expressions raises the issues of denial of rights due to corruption, discrimination and unlawful practices;
2. ‘Harassment of Deepshikha’ by Smt. Supriti Ghosh from Tripura. It is in Bengali with subtitles in English. Inspired by a true story, the film highlights and raises concerns on the issue of body shaming and denial of the right to life with dignity and equal opportunities;
3. ‘Naragam – Hell’ by Shri M. Baskar from Tamil Nadu. It is in Tamil with subtitles in English. Inspired by a true story, the film highlights how citizens’ initiatives can protect violations of human rights;
4. ‘RAHAS’ by Shri Rashid Usman Nimblkar from Maharashtra. It is a silent film. The film highlights the challenges of nomadic tribes in realizing their rights to lead a life with dignity by earning a living through their folk arts.
The full Commission Jury, chaired by the NHRC Chairperson, Justice Shri Arun Mishra comprised Members, Dr. Dnyaneshwar M. Mulay, Shri Rajiv Jain, Smt. Vijaya Bharathi Sayani, Secretary General, Shri Bharat Lal and two external experts, former DG, Doordarshan, Shri Leela Dhar Mandloi and Prof. Rachna Sharma of IIMC.
The senior officers who were part of the initial process of shortlisting the films were also present during the screening for the full Commission Jury.
The aim of the NHRC Short Film Award Scheme since 2015 has been to encourage and acknowledge cinematic and creative efforts of the citizens towards the promotion and protection of human rights. For the ninth edition of this competition in 2023, a total of 114 short films were in the fray for the awards after scrutiny of 139 entries received in different Indian languages from various parts of the country. The awards presentation ceremony will be organized later.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने मीडिया रिपोर्ट की वीडियो क्लिप पर स्वत: संज्ञान लिया है जिसमें 24 जनवरी, 2024 को तेलंगाना के रंगा रेड्डी जिले में प्रोफेसर जयनशंकर तेलंगाना राज्य कृषि विश्वविद्यालय के कुछ छात्रों के आंदोलन के दौरान महिला पुलिस अधिकारियों द्वारा एक प्रदर्शनकारी छात्रा को उसके बालों से घसीटते हुए दिखाया गया है। कथित घटना का वीडियो सोशल मीडिया पर वायरल हो गया है।
आयोग ने पाया है कि मीडिया रिपोर्ट की सामग्री, यदि सत्य है, तो पीड़ित लड़की के मानवाधिकारों के उल्लंघन का गंभीर मुद्दा उठाती है। तदनुसार, आयोग ने मुख्य सचिव और पुलिस महानिदेशक, तेलंगाना को नोटिस जारी कर 4 सप्ताह के भीतर मामले में विस्तृत रिपोर्ट मांगी है। रिपोर्ट में की गई कार्रवाई रिपोर्ट और पीड़ित लड़की की स्वास्थ्य स्थिति भी शामिल होनी चाहिए।
25 जनवरी, 2024 को आई मीडिया रिपोर्ट के अनुसार, छात्र नए उच्च न्यायालय परिसर के निर्माण के लिए विश्वविद्यालय की 100 एकड़ भूमि आवंटित करने के राज्य सरकार के फैसले का विरोध कर रहे थे।

A detailed report sought within four weeks including action taken against the responsible police officials
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report on a video clip showing lady police officials dragging a protesting student by her hair in the Ranga Reddy district of Telangana during an agitation by some students of the Professor JayanshankarTelangana State Agricultural University (PJTSAU) on 24th January, 2024. The video of the reported incident has gone viral on social media.
The Commission has observed that the contents of the media report, if true, raise serious issue of violation of human rights of the victim girl. Accordingly, it has issued notices to the Chief Secretary and the Director General of Police, Telangana calling for a detailed report in the matter within 4 weeks. It should also include the action taken report and health status of the victim girl.
According to the media report, carried on 25th January, 2024, the students were protesting against a decision of the State Government allocating 100 acres of land belonging to the university, for the construction of the new High Court complex.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत के अन्वेषण प्रभाग में तैनात पुलिस उपाधीक्षक श्री ईसम सिंह को गणतंत्र दिवस, 2024 के अवसर पर सराहनीय सेवाओं के लिए पुलिस पदक से पुरस्कृत किया गया है।
वे पश्चिम बंगाल में चुनाव के बाद की हिंसा सहित मानवाधिकार उल्लंघन के मामलों में आयोग की कई घटना स्थल जांच टीमों का हिस्सा रहे हैं तथा उन्होंने हिरासत और मुठभेड़ में हुई मौतों से संबंधित कई केस फाइलों का विश्लेषण किया है। उनके बहुमूल्य योगदान के लिए उन्हें वरिष्ठ अधिकारियों और आयोग से सराहना और प्रशंसा पत्र मिले हैं।
2007 में प्रतिनियुक्ति पर एक निरीक्षक के रूप में आयोग में शामिल होने से पहले, श्री सिंह ने उप-निरीक्षक के पद पर एक सुरक्षा अधिकारी के रूप में रिफाइनरी, पोर्ट ट्रस्ट आदि सहित विभिन्न सार्वजनिक क्षेत्र के उपक्रमों में सेवा दी थी। उन्हें 2013 में आयोग में शामिल किया गया था और 2015 में पुलिस उपाधीक्षक के रूप में पदोन्नत किया गया था।

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया है कि मध्य प्रदेश के इंदौर में एक अनाथालय में चार से चौदह साल के बच्चों पर अत्याचार किया जा रहा था और बाल कल्याण समिति की शिकायत पर पुलिस ने इस मामले में एफआईआर दर्ज की है। कथित तौर पर, इंदौर के अलावा, अनाथालय की चार राज्यों राजस्थान, गुजरात, पश्चिम बंगाल और कर्नाटक के जोधपुर, सूरत, कोलकाता और बेंगलुरु में भी ब्रांचे हैं।
आयोग ने पाया है कि समाचार रिपोर्ट की सामग्री, यदि सच है, तो यह अनाथालय में कैदियों के मानव अधिकारों का घोर उल्लंघन है। इसमें कहा गया है कि विधि सम्मत कार्रवाई करते हुए इंदौर में पुलिस ने एफआईआर दर्ज कर ली है, लेकिन मामला अंतरराज्यीय है। अत: इंदौर के बाहर स्थित अनाथालय की अन्य ब्रांचों की भी जांच/निरीक्षण आवश्यक है।
तदनुसार, इसने राजस्थान, गुजरात, पश्चिम बंगाल और कर्नाटक राज्यों के मुख्य सचिवों और पुलिस महानिदेशकों को नोटिस जारी कर समाचार रिपोर्ट में उल्लिखित अनाथालय की शाखाओं की जांच/निरीक्षण करने के बाद मामले में कार्रवाई रिपोर्ट मांगी है। उनसे अपेक्षा की जाती है कि वे 4 सप्ताह के भीतर दोषी व्यक्तियों के खिलाफ की गई कार्रवाई सहित अपनी विस्तृत रिपोर्ट प्रस्तुत करेंगे।
मध्य प्रदेश राज्य के मुख्य सचिव और डीजीपी को 4 सप्ताह के भीतर मामले में आगे की गई कार्रवाई के बारे में बताने का भी निर्देश दिया गया है।
19 जनवरी, 2024 को प्रकाशित समाचार रिपोर्ट के अनुसार, इंदौर के जिला कलेक्टर ने कहा कि सीडब्ल्यूसी टीम ने किशोर न्याय (बच्चों की देखभाल और संरक्षण) अधिनियम का उल्लंघन पाया है और उन्होंने छात्रावास को सील कर दिया है और बच्चों को सरकारी सुविधाओं में स्थानांतरित कर दिया है।

NHRC DySP Shri Isam Singh chosen for the President’s police medal for meritorious services
Shri Isam Singh, Deputy Superintendent of Police posted in the Investigation Division of the National Human Rights Commission, NHRC, India has been chosen for the Police Medal for Meritorious Services on the occasion of Republic Day, 2024.
He has been part of several spot enquiry teams of the Commission in the cases of human rights violations including, among others, the post-poll violence in West Bengal and has analyzed several case files relating to custodial and encounter deaths. He has received appreciation and commendation letters from the senior officers and the Commission for his valuable contribution.
Prior to joining the Commission as an Inspector on deputation in 2007, Shri Singh had served various public sector undertakings including Refineries, Port Trusts etc. as a security officer in the rank of a Sub-Inspector. He was absorbed in the Commission in 2013 and promoted as DySP in 2015.

Reports also sought from the M. P. Government on the further steps taken in the matter
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report that the children aged between four and fourteen years were being subjected to torture at an orphanage in Indore, Madhya Pradesh and the police has registered an FIR in the matter on a complaint by the Child Welfare Committee. Reportedly, apart from Indore, the orphanage has its branches in Jodhpur, Surat, Kolkata and Bengaluru under four states of Rajasthan, Gujarat, West Bengal and Karnataka.
The Commission has observed that the contents of the news report, if true, amounts to serious violation of human rights of the inmates at the orphanage. It has noted that taking lawful action, an FIR has been registered by the police at Indore, but the matter has inter-state ramification. Therefore, an enquiry/ inspection of the other branches of the orphanage, situated outside Indore is also necessary.
Accordingly, it has issued notices to the Chief Secretaries and the Directors General of Police of the States of Rajasthan, Gujarat, West Bengal and Karnataka calling for an action taken report in the matter after conducting an enquiry/ inspection of the branches of the orphanage mentioned in the news report. They are expected to submit their detailed reports including the action taken against the responsible persons, within 4 weeks.
The Chief Secretary and DGP of the State of Madhya Pradesh are also directed to indicate the further steps taken in the matter, within 4 weeks.
As per news report, carried on 19th January, 2024, the District Collector of Indore said that the CWC team has found violations of the Juvenile Justice (Care and Protection of Children) Act and they have sealed the hostel and shifted the children to government facilities.

गैर-अधिसूचित समुदायों की समस्याओं पर ठोस प्रयासों और आगे की चर्चा की आवश्यकता ने उनके मानवाधिकारों को प्रभावित करने वाले मुद्दों पर विचार करने पर जोर दिया
राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने आज 19 जनवरी, 2024 को अपने परिसर में "भारत में घुमंतू , अर्ध घुमंतू और गैर-अधिसूचित जनजातियों (एनटी, एसएनटी और डीएनटी) की सुरक्षा और भविष्य की योजनाओँ " पर एक ओपन हाउस चर्चा का आयोजन किया। एनएचआरसी, भारत के सदस्य, डॉ. ज्ञानेश्वर एम. मुले ने सदस्यों श्री राजीव जैन, श्रीमती विजया भारती सयानी, संयुक्त सचिव श्रीमती अनीता सिन्हा और देवेंद्र कुमार निम की उपस्थिति में चर्चा का उद्घाटन किया।
डॉ. मुले ने कहा कि जीवन का अधिकार, समानता, गरिमा और स्वतंत्रता मानव अधिकारों के चार प्रमुख स्तंभ हैं और प्रत्येक नागरिक उसके बीते हुए समय के आधार पर आंके बिना, आगे बढ़ने और योगदान करने का समान अवसर पाने का हकदार है। उन्होंने कहा कि गैर-अधिसूचित जनजातियों, घुमंतू जनजातियों और अर्ध-घुमंतू जनजातियों को भी आजीविका के उचित साधनों की आवश्यकता है।
उन्होंने कहा कि "आपराधिक प्रवृत्ति" वाली गैर-अधिसूचित जनजातियों के बारे में औपनिवेशिक मानसिकता को बदलने की जरूरत है ताकि यह सुनिश्चित किया जा सके कि उनके मानव अधिकारों का उल्लंघन न हो। उनकी पहचान के उचित दस्तावेजीकरण में तेजी लाने की जरूरत है ताकि उन्हें कल्याणकारी योजनाओं का लाभ मिल सके और उन्हें बुनियादी जरूरतें प्रदान की जा सकें। उन्होंने इस बात पर जोर दिया कि विभिन्न हितधारकों को उनके मानव अधिकारों को प्रभावित करने वाले मुद्दों को सुव्यवस्थित करने के लिए ठोस प्रयासों और चर्चाओं की आवश्यकता है।
इससे पहले, अपने स्वागत भाषण में, एनएचआरसी के संयुक्त सचिव, श्री देवेन्द्र कुमार निम ने कहा कि गैर-अधिसूचित जनजातियों, घुमंतू और अर्ध-घुमंतू जनजातियाँ सबसे अधिक उपेक्षित, हाशिए पर और आर्थिक और सामाजिक रूप से वंचित समुदाय हैं। उन्होंने कहा कि गैर-अधिसूचित समुदायों के लिए सबसे गंभीर मुद्दों में से एक नागरिकता दस्तावेजों की कमी है, जो उनकी पहचान को अदृश्य बना देता है और सरकारी लाभ, संवैधानिक और नागरिकता अधिकार प्राप्त करने में बाधा उत्पन्न करता है।
चर्चा को निम्न तीन तकनीकी विषयों में विभाजित किया गया:
• आपराधिक जनजाति अधिनियम, 1872 और बाद में आदतन अपराधी अधिनियम, 1952 के अधिनियमन द्वारा लगाए गए कलंक के कारण एनटी, एसएनटी और डीएनटी के सामने आने वाली चुनौतियों की पहचान करना और बाद के भेदभावपूर्ण प्रावधानों को संशोधित करने का तरीका निकालना।
• शिक्षा, रोजगार, स्वास्थ्य देखभाल और कानूनी दस्तावेजों जैसी बुनियादी सुविधाओं का लाभ उठाने में समुदायों द्वारा सहन की जाने वाली बाधाओं को समझना।
• सभी उजागर चुनौतियों को कम करने के उपाय सुझाना, संसद, सरकारी संस्थानों और उच्च शिक्षा में गैर-अधिसूचित जनजातियों का प्रतिनिधित्व सुनिश्चित करना और विशेष रूप से महिलाओं और बच्चों के लिए आगे बढ़ने का रास्ता निर्धारित करना।
वक्ताओं द्वारा जिन मुद्दों पर प्रकाश डाला गया उनमें इन समुदायों के लिए एक स्थायी आयोग की स्थापना के लिए इडेट आयोग की रिपोर्ट का कार्यान्वयन,आदतन अपराधी अधिनियम, 1952 को निरस्त करना और यदि नहीं, तो अधिनियम में निर्धारित नोडल अधिकारियों के साथ गैर-अधिसूचित जनजाति समुदाय के एक प्रतिनिधि की नियुक्ति, एससी/एसटी/ओबीसी के तहत डीएनटी/एनटी/एसएनटी को शामिल न करना और कई अन्य बातों के अलावा, पूर्व के लिए विशिष्ट नीतियों का निर्माण शामिल है।
डॉ. मुले ने अपने समापन भाषण में कहा कि आयोग चर्चा में उठाए गए मुद्दों के साथ-साथ गैर-अधिसूचित आदिवासी समुदायों द्वारा सामना की जा रही समस्याओं और चुनौतियों पर प्राप्त विभिन्न अन्य इनपुटों पर भी विचार-विमर्श करेगा और फिर सरकार को उनके मानव अधिकारों में सुधार के लिए आवश्यक सिफारिशें करेगा।
आयोग के वरिष्ठ अधिकारियों के अलावा, प्रतिभागियों में केंद्रीय सामाजिक न्याय और अधिकारिता मंत्रालय के भारतीय मानव विज्ञान सर्वेक्षण के वरिष्ठ अधिकारी, राष्ट्रीय गैर-अधिसूचित जनजाति एवं घुमंतू जनजाति आयोग, नीति आयोग, गैर-अधिसूचित जनजाति घुमंतू जनजाति विकास परिषद, टीआईएसएस, राष्ट्रीय अनुसूचित जनजाति आयोग, शिक्षाविद, विशेषज्ञ और गैर सरकारी संगठन भी शामिल थे।

The National Human Rights Commission, NHRC, India organized an Open House Discussion on “Protection of Nomadic, Semi Nomadic and De-Notified Tribes (NTs, SNTs and DNTs) in India and forward trajectory” today on 19th January, 2024 at its premises. The NHRC, India Member, Dr. Dnyaneshwar M. Mulay inaugurated the discussion in the presence of the Members Shri Rajiv Jain, Smt Vijaya Bharati Sayani, Joint Secretaries Smt Anita Sinha and Devendra Kumar Nim.
Dr Mulay said that the right to life, equality, dignity and liberty are the four major pillars of human rights and every citizen, regardless of background, deserves an equal opportunity to thrive and contribute. He said that the De-Notified Tribes, Nomadic Tribes and Semi-Nomadic Tribes also require proper means of livelihood.
He said that the colonial mindset about the De-Notified Tribes having "criminal tendencies" needs to change to ensure their human rights are not violated. Proper documentation of their identities needs to be speeded up so that they get the benefits of welfare schemes and the basic needs are provided to them. He emphasized that the different stakeholders need concerted efforts and discussions to streamline the issues impacting their human rights.
Earlier, in his welcome address, NHRC Joint Secretary, Shri Devendra Kumar Nim said that the De-Notified, Nomadic and Semi-Nomadic Tribes remain the most neglected, marginalized and economically and socially deprived communities. He said that one of the most pressing issues for De-Notified communities is the lack of citizenship documents, which makes their identity invisible and causes hindrances in obtaining government benefits, constitutional and citizenship rights.
The discussions were divided into three technical themes as follows:
To identify challenges faced by the NTs, SNTs and DNTs owing to the stigma imposed by the enactment of the Criminal Tribes Act, 1872 and later by the Habitual Offenders Act, 1952 and figure out a way to modify discriminatory provisions of the latter.
To discern hurdles endured by the communities in availing basic facilities such as education, employment, health care, and legal documents, among others.
To suggest measures to mitigate all the uncovered challenges, ensure representation of De-Notified tribes in parliament, government institutions and higher education, and determine a way to proceed, especially for women and children.
The issues highlighted by the speakers included the implementation of the Idate Commission report for setting up a permanent commission for these communities, repeal of the Habitual Offenders Act, 1952 and if not, the appointment of a representative of De-notified Tribe community with the nodal officers as stipulated in the Act, non-inclusion of DNTs/NTs/SNTs under the SC/ST/OBC and formulation of specific policies for the former, among many others.
In his concluding remarks, Dr. Mulay said that the Commission will further deliberate on the issues raised in the discussions as well as the various other inputs received on the problems and challenges being faced by the De-Notified tribal communities and then make necessary recommendations to the government to ameliorate the cause of their human rights.
In addition to the senior officers of the Commissions, the participants, among others, included senior officers of the Union Ministry of Social Justice and Empowerment Anthropological Survey of India, National Denotified & Nomadic Tribes Commission, Niti Ayog, De-Notified Nomadic Tribes Development Council, TISS, National Commission for Scheduled Tribes, academicians, experts and NGOs.

राष्ट्रीय मानव अधिकार आयोग की संस्तुतियों पर राजस्थान सरकार, उन बस यात्रियों जिनकी बिजली का करंट लगने से मौत हो गयी, को 30 लाख रुपये की राहत राशि का भुगतान करने के लिए सहमत
राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने राजस्थान सरकार द्वारा कोई लापरवाही न करने की दलील को खारिज करते हुए सिफारिश की, कि राजस्थान सरकार उन छह यात्रियों में से प्रत्येक के निकटतम सम्बन्धी को 5 लाख रुपये का भुगतान करे, जिनकी बस के 16 जनवरी, 2021 को जालोर जिले में एक बिना सुरक्षा वाले हाई वोल्टेज तार के संपर्क में आने पर बिजली का करंट लगने से मौत हो गई थी। राज्य सरकार ने इसे स्वीकार कर लिया है और मृतक पीड़ितों के निकटतम सम्बन्धी को राहत राशि का भुगतान कर रही है।
आयोग ने शिकायत के आधार पर घटना का संज्ञान लिया था और राजस्थान सरकार के विद्युत विभाग से रिपोर्ट मांगी थी। रिकॉर्ड पर मौजूद सामग्री के आधार पर, आयोग इस निष्कर्ष पर पहुंचा कि सड़क पर बिजली के खंभे को ठीक करने में बिजली विभाग की ओर से लापरवाही की गई थी। 11 केवी विद्युत कनेक्शन में सुरक्षा की कमी थी जो केंद्रीय विद्युत विनियमन 2010 की धारा 73 का उल्लंघन था ।
आयोग के कारण बताओ नोटिस के जवाब में कि पीड़ितों के परिजनों को 5-5 लाख रुपये की राहत राशि का भुगतान करने की सिफारिश क्यों नहीं की जानी चाहिए, राज्य सरकार ने कहा था कि उसके बिजली विभाग की ओर से कोई लापरवाही नहीं हुई थी और इसलिए, राहत का सवाल ही नहीं उठता। साथ ही विभिन्न कारणों का हवाला देते हुए, इसमें कहा गया है कि यह घटना तार के टूटने और गार्डिंग के अभाव के कारण नहीं हुई, बल्कि बस को उस स्थान से ले जाते समय कंडक्टर द्वारा विद्युत प्रणाली के साथ छेड़छाड़ करने के कारण हुई, जहां वाहनों की ज्यादा आवाजाही नहीं थी। इसीलिए उक्त लाइन के नीचे 11 केवी बिजली कनेक्शन की कोई गार्डिंग नहीं थी। यह भी उल्लेखनीय है कि 16.1.2021 को जालोर पुलिस स्टेशन में दर्ज की गई एफआईआर भी अंतिम रिपोर्ट में खारिज की जा चुकी है एवं अदालत ने भी इसे स्वीकार कर लिया। इसलिए, वे इस मामले में कोई मुआवजा देने के लिए उत्तरदायी नहीं थे।
हालांकि, 3.10.2023 की कार्यवाही के बाद आयोग ने कहा कि विद्युत विभाग केंद्रीय विद्युत प्राधिकरण विनियमन, 2010 की धारा 73 में दिए गये अपने उत्तरदायित्व से इनकार नहीं कर सकता है, जिसमें स्पष्ट रूप से कहा गया है कि प्राधिकरण विद्युत संयंत्रों और विद्युत लाइनों के निर्माण, संचालन और रखरखाव के लिए सुरक्षा आवश्यकताओं को निर्दिष्ट करेगा। तदनुसार, आयोग ने छह मृतकों के परिजनों को राहत के भुगतान की संस्तुति दोहराई और भुगतान के प्रमाण के साथ अनुपालन रिपोर्ट मांगी। राज्य सरकार ने सूचित किया है कि उसने आयोग की संस्तुति के अनुसार कुछ पीड़ितों के रिश्तेदारों को राहत का भुगतान कर दिया है, और शेष को भी राहत भुगतान की प्रक्रिया चल रही है।

On the NHRC recommendations, the Rajasthan Government agrees to pay the relief of Rs 30 lakh in the case of electrocution of bus passengers
The National Human Rights Commission, NHRC, India setting aside the no negligence contention of the Rajasthan Government recommended that it pay Rs. 5 lakh each to the Next of Kin (NoK) of the six passengers who died due to electrocution when their bus came into contact with an unguarded high voltage wire in the Jalore district on 16th January, 2021. The State Government has accepted it and is making the payment of the relief to the Next of Kin of the deceased victims.
The Commission had taken cognizance of the incident based on a complaint and called for the reports from the Electricity Department of the Government of Rajasthan. Based on the material on record, it concluded that there was negligence on the part of the Electricity Department in fixing the electricity poles on the road. There was the absence of guarding the 11 KV electricity connection which was in contravention to Section 73 of Central Electricity Regulation 2010.
In response to the Commission’s notice to show cause why relief of Rs 5 lakh each to the NoK of the victims should not be recommended to be paid, the state government had maintained that there was no negligence on the part of its Electricity Department and hence, the question of relief did not arise. Citing, various reasons among others, it said that the incident did not happen due to the breakage of wire and absence of guarding but because of tampering with the electrical system by the conductor while guiding the bus from a point where there was not much movement of vehicles. That is why there was no guarding of the 11 KV electricity connection below the said line. It was also stated that even the FIR lodged with the Jalore Police Station on 16.1.2021 ended up in the final report and was also accepted by the court. Hence, they were not liable for providing any compensation in the matter.
However, the Commission vide proceedings dated 3.10.2023 held that the electrical department could not forego its liability given in section 73 of Central Electricity Authority Regulation 2010, which categorically states that the authority shall specify safety requirements for construction operation and maintenance of electrical plants and electric lines. Accordingly, it reiterated the recommendation for the payment of relief to the NoK of the six deceased and called for a compliance report along with proof of payment. The State Government has informed that it has paid relief to the NoK of some of the victims as recommended by the Commission, and the remaining are also in the process of being paid relief.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया है कि 5 जनवरी, 2024 को तेलंगाना के रंगारेड्डी जिले में इंजीनियरिंग की एक छात्रा ने अपने महाविद्यालय की पांचवीं मंजिल से कूदकर आत्महत्या कर ली। कथित तौर पर, पीड़िता तीन महीने पहले ही महाविद्यालय जॉइन किया था और कुकटपल्ली स्थित अपने आवास से रोजाना महाविद्यालय बस से आती-जाती थी।
आयोग ने पाया है कि समाचार रिपोर्ट की सामग्री, यदि सत्य है, तो यह पीड़िता के मानव अधिकारों के उल्लंघन का गंभीर मुद्दा उठाती है, जो चिंता का विषय है। तदनुसार, आयोग ने तेलंगाना सरकार के मुख्य सचिव और पुलिस महानिदेशक को नोटिस जारी कर चार सप्ताह के भीतर मामले में विस्तृत रिपोर्ट मांगी है। रिपोर्ट में महाविद्यालय प्रशासन द्वारा की गई पुलिस जांच और जांच के नतीजे, घटना के लिए जिम्मेदार पाए गए व्यक्तियों के खिलाफ की गई कार्रवाई तथा ऐसी दर्दनाक घटनाएं दोबारा न हों, यह सुनिश्चित करने के लिए उठाए गए या प्रस्तावित कदम भी शामिल होने चाहिए।
6 जनवरी, 2024 को आई मीडिया रिपोर्ट के अनुसार, प्रत्यक्षदर्शियों ने कहा कि पीड़िता ने यह दर्दनाक कदम उठाया, जबकि उसके साथी छात्र उसे रुकने के लिए अनुरोध कर रहे थे। छात्रों और महाविद्यालय प्रबंधन द्वारा उसे इस्नापुर के एक निजी अस्पताल में ले जाया गया, जहां डॉक्टरों ने उसे "मृत" घोषित कर दिया।

NHRC notice to the Government of Telangana over the reported suicide of an Engineering girl student at her college in Rangareddy district
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report that an Engineering girl student committed suicide by jumping from the fifth floor of her college in Rangareddy district, Telangana on 5th January, 2024. Reportedly, the victim had joined the college just three months ago and was commuting daily by the college bus from her residence in Kukatpally.
The Commission has observed that the contents of the news report, if true, raise a serious issue of violation of human rights which is a matter of concern. Accordingly, it has issued notices to the Chief Secretary and the Director General of Police, Government of Telangana calling for a detailed report in the matter within four weeks. The report should also include the outcome of the police investigation and inquiry conducted by the college administration, the action taken against the persons found responsible for the incident, and steps taken or proposed to be taken to ensure that such painful incidents do not recur.
According to the media report, carried on 6th January, 2024, the eyewitnesses said that the victim took the extreme step even as her fellow students screamed at her to stop. She was rushed to a private hospital in Isnapur by the students and college management, where the doctors pronounced her “brought dead”.

राष्ट्रीय मानव अधिकार आयोग, एनएचआरसी, भारत ने एक मीडिया रिपोर्ट पर स्वत: संज्ञान लिया है,रिपोर्ट के अनुसार बिहार के मुंगेर जिले में प्राथमिक स्वास्थ्य केंद्र (पीएचसी) में ऑक्सीजन सिलेंडर की अनुपलब्धता के कारण एक हृदय रोगी की जान चली गई। कथित तौर पर यह घटना 26 दिसंबर, 2023 को घटित हुई थी।
आयोग ने पाया है कि समाचार रिपोर्ट की सामग्री, यदि सच है, तो यह मानव अधिकारों के उल्लंघन का गंभीर मुद्दा है, जो चिंता का विषय है। तदनुसार, आयोग ने बिहार सरकार के मुख्य सचिव को नोटिस जारी कर चार सप्ताह के भीतर विस्तृत रिपोर्ट मांगी है। रिपोर्ट में आरोपियों के खिलाफ की गई कार्रवाई की स्थिति के साथ-साथ मृतक के निकटतम सम्बन्धी को प्रदान की गई राहत और पुनर्वास की स्थिति भी शामिल होनी चाहिए।
28 दिसंबर 2023 की मीडिया रिपोर्ट के मुताबिक, स्वास्थ्य केंद्र के इमरजेंसी वार्ड में तैनात डॉक्टर ने आरोप लगाया है कि मरीज के लिए ऑक्सीजन सिलेंडर उपलब्ध नहीं था, जबकि प्रभारी चिकित्सा पदाधिकारी ने कहा है कि ऑक्सीजन सिलेंडर की कोई कमी नहीं है।

NHRC notice to the Bihar Chief Secretary over the reported death of a patient due to non-availability of oxygen at a PHC in Munger district
The National Human Rights Commission, NHRC, India has taken suo motu cognizance of a media report that a heart patient lost life due to the non-availability of oxygen cylinders at the Primary Health Centre (PHC) in Munger district, Bihar. The incident reportedly happened on 26th December, 2023.
The Commission has observed that the contents of the news report, if true, raise a serious issue of violation of human rights, which is a matter of concern. Accordingly, it has issued notice to the Chief Secretary, Government of Bihar calling for a detailed report within four weeks. The report should also include the status of the action taken against the accused as well as relief and rehabilitation provided to the Next of Kin of the deceased.
According to the media report, carried on 28th December, 2023, the doctor posted at the Emergency Ward of the health centre has alleged that the oxygen cylinder for the patient was not available, while, the In-charge Medical Officer has said that there is no scarcity of the oxygen cylinders.
