A boy's death due to falling in an open pit
(Case No.638/30/6/2011)

Media carried a report on the 21st February, 2011 alleging that 12 years old Abhishek accidently fell into an open pit near the construction site of a hospital at Haidarpur village in Delhi and died. He met with the tragedy while he was playing with his friends near the construction site around 6 pm on the 19th February, 2011. The 12 feet deep pit was without any boundary wall and there was no watchman either at the construction site to caution the people.
Taking suo motu cognizance of the media report the Commission observed on the 24th February, 2011 that the contents therein, if true, raise serious issues of violation of human rights of Abhishek who lost his life due to negligence of the hospital authorities, the Government of NCT of Delhi and the Municipal Corporation of Delhi as they did not ensure safety precautions around the construction site.
Accordingly, it issued notices to the Chief Secretary, Government of NCT of Delhi, the Commissioner, Municipal Corporation of Delhi and the Director Max Healthcare Institute Limited calling for their reports in the matter.
