Armed Forces should act in conformity with law : Member NHRC

Shri P.C. Sharma, Member of the Commission while delivering the valedictory address at a seminar on Human Rights organized by the 3rd Division of the Indian Amy at Karu, Leh reminded the forces that they must act in conformity with the Constitution, the laws of the land and the treaty obligations of the country especially when combating terrorism. He told the audience that the Commission has been at great pains to impress upon the armed forces of India and the police that, even as they must perform their duty to the nation to fight and triumph over terrorism, they must do so in consonance with the rule of law and taking into consideration the rights of all the people who inhabit it.
He said that the Commission is profoundly grieved when reports are received both of terrorist excesses, and of the excessive use of force by the instrumentalities of State, of unaccounted disappearances or of death, in circumstances that are suspicious, and where allegations are made of "false encounters".
He also said that the Commission is of the firm view that a proper observance of human rights is not a hindrance to the promotion of peace and security. National security is undoubtedly of paramount importance, as without protecting the safety and security of the nation, individual's rights cannot be protected. At the same time, Shri Sharma told the defence personnel that the NHRC is aware and cares for the difficulties faced by the army. He however stressed that when the Commission reaches the conclusion that rights have been violated, it will say so, and expect compliance with its views.
