Delhi Police pays rupees three lakhs in a case of death in police custody

On NHRC recommendations, the Delhi Police has paid rupees three lakhs as interim relief to the mother of Vicky, who died in police custody on the 12th March, 2008 in the national capital.
On consideration of various reports and material on record, the Commission found that Vicky was ill-treated physically by police resulting in his death. A case was also registered by the Delhi Police u/s 304 of IPC, i.e., culpable homicide not amounting to murder.
As per the details of the case, Vicky was detained by police personnel of Dhaula Kuan police station. He was being taken to police post in Delhi Cantt. on foot. On the way, he suddenly fell down complaining pain in his stomach and became unconscious. He was taken to Safdarjung Hospital where he expired. As per medical opinion, possibility of acute pancreastitis as cause of death could not be ruled out. In the absence of any other disease, pancreastitis can be caused by the blunt abdominal injury only.
The Metropolitan Magistrate, New Delhi concluded that in his considered opinion a commission of offence was made out as far as the cause of death of Vicky was concerned and SHO, police station, Delhi Cantt. was directed to register an FIR.
The Delhi police has also informed the Commission that a competent court is regularly monitoring the case registered under FIR 200/2008.
