Departmental action recommended against the erring jail officials in a case of death in prison in UP

Kailash Gupta, an under trial prisoner, aged 50 years was lodged in District Jail, Jaunpur, Uttar Pradesh on the 6th November, 2003 under some sections of IPC. He fell sick on the 20th January, 2004, and was given first aid at the jail hospital.
However, following deterioration in his condition he had to be sent to the District hospital Jaunpur on the 21st January, 2004, but on reaching there, he was declared brought dead.
The expert opinion on the cause of Kailash's death did not rule out the possibility of he being hit by a blunt force impacting his abdomen leading to perforation of large intestine, which caused septicemia and eventually his death.
The Commission, on consideration of the expert opinion and the other material on record, recommended that the Uttar Pradesh Government pay monetary relief of Rs. 1 lakh to the next of the kin of the deceased, and send a compliance report.
The Commission also asked the State Government to take appropriate departmental action against the jail officials, including the doctors, indicted by the Additional District Magistrate in his report.
