Juvenile Justice Act 2000 not implemented in 23 States/UTs

While looking into a complaint of alleged murder of 2 children by a female juvenile, it came to the attention of the National Human Rights Commission that only some States appear to have implemented the various provisions of Juvenile Justice (Care & Protection of Children) Act, 2000. It immediately directed that a notice be issued to the Chief Secretaries of all the States and Union Territories to furnish the information to the Commission with regard to the implementation of the provisions of Juvenile Justice (Care & Protection of Children) Act, 2000 and especially on whether :-

· The Juvenile Justice (Care & Protection of Children) Act, 2000 been implemented in the State

· Juvenile Justice Board and Protective Homes have been set up in the State, if so, details thereof

· There are certified Homes or Special Homes in which the child will be kept if not released on bail

· There are Child Welfare Committees and Children's Homes.

Based on the feedback received from all the State/UTs, it was found that only 11 States have implemented the provision of the Juvenile Justice (Care & Protection of Children) Act, 2000, which include Chandigarh, Chattisgarh, Delhi, Goa, Gujarat, Haryana, Manipur, Orissa, Rajasthan, West Bengal and Uttar Pradesh. The State Government of Jammu & Kashmir has stated that the Juvenile Justice (Care & Protection of Children) Act, 2000 is not applicable to the State of J&K.
Other States have not implemented the provision or implemented them partially. The Commission has sought further information from the States where the implementation of the provision of the Juvenile Justice (Care & Protection of Children) Act, 2000 has not been made.
