NHRC anguished at the defiant attitude of Bihar, Government.

The National Human Rights Commission is anguished at the defiant attitude of the Government of Bihar as it is refusing to pay reasonable compensation of Two Lakh Rupees to the next of kin of Amitesh Kumar alias Madhukar Sharma killed by police in a fake encounter. The incident happened on 7th February, 2003 in the area of Police Station Paliaganj, Patna. The Commission vide it's proceedings dated 17th May, 2007did not believe the version of Bihar Police that it fired in self defence. The Bihar Government conveyed that it paid an amount of One Lakh Rupees only to the next of kin of the deceased citing financial constraint in paying the balance amount of Rupees One Lakh. In subsequent proceedings the Commission reiterated its recommendation and called upon the State Government to report compliance saying that financial constraints can not be a ground for refusing to pay compensation. Again in a letter dated 16th July, 2008 Bihar Government communicated that it is not possible for it to pay the balanced amount. The Commission in its proceeding dated 5th January, 2009 passed an order asking the State Government to comply with its recommendations and report with proof of payment within six weeks from the date of receipt of this order. It also stated that if any injury to the life and property results from an act from the Government or its employees the State Government should be ready and willing to apply balm to the affected person by giving monitory relief as responsible Government.
