NHRC ASKS FOR FACTUAL REPORT FROM CHIEF SECRETARY AND DGP OF J&K GOVT. ON FAKE ENCOUNTER CASE

The National Human Rights Commission has asked the Chief Secretary and Director General of Police, Govt. of Jammu & Kashmir, for a factual report on the News paper clippings, captioned ' Four more held in J&K fake encounter case', mentioned that the four SOG personnel gunned down Paddar and passed him off as a Pakistani Commander of the Laskhar - e- Tayibba in the intervening night of December 8 and 9, 2006.
Taking suo-motu cognizance of the newspaper report, appeared in the 'Asian Age' and 'Hindustan Times' on 31st January, 2007, which further indicated that the Jammu & Kashmir Police on 30th January, 2007 arrested four more members of the counter insurgency Special Operation Group (SOG) namely Head Constables Muhammed Ashraf, Surender Kumar and Krishen Chand and Constable Shamim Ahmed for their alleged involvement in killing people in fake encounters to claim government rewards. The report mentions that all the four-policemen arrested were a part of the team that allegedly killed carpenter Abdul Rehman Paddar in an alleged fake encounter in Ganderbal area on the outskirts of Srinagar recently.
After going through the report, the Commission has said if the contents are true, they raise the serious issue of violation of human rights of citizens.
The Commission has directed that copies of the newspaper reports be transmitted to the Chief Secretary and Director General of Police, Govt. of Jammu & Kashmir for sending a factual report indicating, ex-gratia relief, if any, sanctioned for the next of kin of the deceased, within two weeks.
