NHRC directs compensation for atrocities by Delhi Police
The National Human Rights Commission has directed for monetary compensation to be paid by the Delhi Government to four victims who suffered atrocities in the hands of Delhi Police officials.
The Commission had received a petition from one Dara Singh alleging that he and three other persons were illegally detained in the Anand Parbat Police Station. Apparently, they were detained in the police station on the night of 26 March 2000 at the instance of one Smt. Veero Devi, who was a land grabber. All the four were brutally beaten by the SHO of the Police Station, Inspector A.S. Tyagi. Later, they were implicated in a false case u/s 506, 354 of the IPC. The complainant had also attached photographs of the injuries they had sustained along with his petition to the Commission.
Upon the directions of the Commission, an inquiry was conducted into the matter by the Commission’s Investigation Division, which examined a number of witnesses, the Medico-legal and other related reports. The police had denied the allegation and said that the complainants had neither been detained overnight nor tortured – they had been arrested on 27 March 2000 and the injuries were already present on their body at that time. This was however, refuted by the medical report. A constable, Shri Sansar Singh of the same Police Station, had also told the Investigating Team, that Shri Tyagi had manipulated the register of the police station to record his absence during the time of the incident but had remained there.
Meanwhile on 7 April 2000, the Commission received a communication from Shri Sansar Singh in which he expressed his apprehension of danger to life for telling the truth to the Commission. He requested the Commission to get him transferred.
After considering the report and evidences collected by the Investigation Team, the Commission was of the opinion that Shri A.S. Tyagi was to be held responsible for illegally detaining four persons and torturing them. Thus, the Commission recommended payment of compensation of Rs.10,000/- each to the four victims for the torture inflicted on them in custody. It has directed that departmental inquiry be made against Shri A.S. Tyagi to ascertain his liability. Action should be taken based on the findings of the departmental inquiry. The Commission has also directed that Shri Sansar Singh be transferred from Anand Parbat Police Station in view of his apprehension, which the Commission finds to be reasonable.
