NHRC gets PF and Gratuity amount paid to a woman nearly seven years after her husband's death in Uttar Pradesh

The National Human Rights Commission's persistence with the Uttar Pradesh Government finally resulted in payment of Gratuity, Provident Fund and Earned Leave amount to the wife of deceased Mitranand Srivastava nearly seven years after his accidental death. It was on his wife's complaint dated 3rd November, 2009 that the Commission on the 27th November, 2009 issued a notice to the Secretary, Department of Agriculture, Lucknow, Uttar Pradesh calling for report.
Mitranand Srivastava was working as a clerk in Sahkari Ganna Vikas Samiti Ltd., Khadda, Kushinagar in the State. On the 26th November, 2005 he met with an accident while boarding a train and died on the spot. Thereafter, his wife got service on compassionate ground as a Class IV employee. But his department did not pay any heed to his wife's requests for payment of rightful dues to her.
The Commission had to send two reminders and thereafter a conditional summon for personal appearance of Secretary, Department of Agriculture, Govt. of Uttar Pradesh before the Govt. of Uttar Pradesh finally informed vide letter dated 4th April, 2011 that an amount of Rs. 3,26,997/- was paid to the complainant clearing all her dues.
The Commission vide its proceeding dated 28th September, 2011 asked for the confirmation of the same from the complainant following which she responded vide her letter dated 11th October, 2011 that indeed the long over due amount was paid to her by the Uttar Pradesh Government. The Commission recorded these facts in its final proceedings in the matter on the 2nd January, 2012.
