NHRC gives six weeks to Delhi Police to respond on Magisterial inquiry into Batla House shootout incident

The Commission has asked the Delhi Police to apprise it of the decision taken by the Lt. Governor regarding the magisterial probe into Batla House shootout incident on 19.09.2008 in Jamia Nagar, New Delhi in response to the Commission's further queries from Commissioner of Police, Delhi vide its proceedings dated 17.10.2008 into the incident. The Commission in its order dated 22nd Dec. 2008 has sought response within six weeks. This follows an interim report received from Additional Commissioner of Police (Vigilance, Delhi) on 19th November, 2008.
The Additional Commissioner of Police (Vigilance, Delhi) has communicated that F.I.R. No. 208/2008 was registered at Police Station, Jamia Nagar regarding the incident. The case was initially investigated by the local police and on 01.10.2008, the investigation was transferred to the Crime Branch which is a specialized and an independent agency. It has been further explained in the communication that on the request of the Crime Branch, a team of CSFL had inspected the seen of occurrence on 13.10.2008. The Additional Commissioner of Police (Vigilance, Delhi) also communicated that "the issue regarding the Magisterial probe in the events relating to the incident dated 19.09.2008 has been referred to Lt. Governor, Delhi".
It may be recalled that two person identified as Mohd. Atif Ameen and Mohd. Sajid were killed in a shootout at Flat No. 108 of L-18, Batla House, Jamia Nagar, New Delhi on 19.09.2008. The police authorities claimed that both persons were involved in the serial bomb blasts which were taken place a few days earlier in Delhi. It was claimed that police has raided Flat No. 108 of L-18, Batla House, Jamia Nagar, New Delhi in consequence of secret information and the persons hiding in the flat had fired at the police party as soon as it entered the flat and then the police also fired in self defence. One police officer Mohan Chand Sharma also succumbed to his injuries during the shootout.
The Commission took up the cognizance of the incident on 23rd September, 2008 on a complaint submitted by an NGO, Real Cause on 21st September, 2008 raising doubts about the Police version.
