NHRC intervention ensures action against delinquent officials, relief to families in a case of wall collapse in Himachal Pradesh

The NHRC intervention has ensured that the Himachal Pradesh government paid monetary relief of rupees two lakh each to the next of kin of four children who died due to collapse of a boundary wall of a primary school in Chhatarpur village, District Una on 7th February, 2011. The children were in age group of 7to 11 years.

This amount was recommended to be paid in addition to rupees one lakh already given by the State to them under HP Emergency Relief Fund. The Commission had held that rupees one lakh as monetary relief given by the State was inadequate for the loss of lives of children who died as a direct result of the negligence of public servants.

The Commission had also observed that no action appeared to had been taken against the public servants who, according to the magisterial enquiry, had contributed to the tragedy, by proposing a faulty design and by not inspecting the quality of the construction.

In response, the State government has sent a compliance report alongwith the proof of payment. Further, an FIR No.28.11 u/s 336/304A/42/120B/338 IPC Challan had been prepared against the officials/ members of Village Education Committee, Chhatarpur Thada and others.
