NHRC issues notices to the Centre and the J&K Government on allegations of a fake encounter

The National Human Rights Commission, NHRC has taken cognizance of complaints alleging that one Ashok Kumar was shot dead by a Special Police Officer, SPO and an Army personnel showing him as a terrorist named Abu Usman alias Abu Adnan alias Doctor of Lashkar-e-Taiba on the 7th August, 2011 in Poonch District of Jammu & Kashmir. Allegedly Ashok was a mentally challenged person.

On consideration of complaints, the Commission issued notices to the Director General of Police, J&K, District Magistrate and Superintendent of Police, Poonch and the Secretary, Ministry of Defence, Government of India and directed them to take appropriate action with regard to the investigation of the case as per guidelines laid down by the Commission. The Commission has sought magisterial enquiry report, post-mortem report along with report of independent investigation within eight weeks.

The Commission has also asked the Superintendent of Police, Poonch to explain as to why the intimation regarding the death in police action was not reported to it within 48 hours in the prescribed format as per the NHRC revised guidelines communicated to all the Chief Ministers vide a letter dated 12th May, 2010.
