NHRC issues show cause notice to UP Government in a case of gang rape in District Bijnore

In response to a notice of the National Human Rights Commission, the Uttar Pradesh Government has not only confirmed the gang rape of a girl in District Bijnore but also local police inaction. Terming the findings in the case as very disturbing and shocking, the Commission has issued a show cause notice to the State Chief Secretary to show cause why monetary relief should not be recommended to be paid to the victim. He is expected to respond within six weeks, failing which the matter will be decided on merits.
The Commission had issued a notice on 18th April, 2013 taking suo motu cognizance of a media report alleging gang rape of a girl in District Bijnore, Uttar Pradesh on 11th April, 2013. The unconscious girl was left bleeding in an open field by the offenders. It was only the next day after gaining consciousness that her uncle found her.
The State Government's reports revealed that when the hapless and helpless girl approached Police Station Afzalgarh along with her family members to lodge a complaint, the law was not set in motion. The local police, instead of initiating any legal action, mounted pressure on the victim and her family members to enter into a compromise. For this, even the victim was physically assaulted by a woman constable. A complaint was finally registered on 15th April, 2013 against the two accused, when the victim's father approached the Additional SP, Rural, Bijnore.
A criminal case was also registered against the SHO, Sub-Inspector and woman Constable on 16th April, 2013 for delay in registration of the case and a charge sheet has been submitted against them. All the three police personnel have been placed under suspension and departmental action has been initiated.
The Commission has asked the Director General of Police, UP to submit the status of both the criminal cases and the outcome of the departmental action against the delinquent police personnel within six weeks.
