NHRC notice to the Uttar Pradesh Government on denial of admission in a school to a rape victim Dalit girl


New Delhi, September 13th, 2012

The National Human Rights Commission, on the basis of a media report, has issued notices to the Chief Secretary and the Director General of Police, Government of Uttar Pradesh calling for reports within four weeks into the allegations that a Dalit girl was denied admission in a village school in District Bijnor, as she was the victim of a gang rape.

The Commission observed that the media report, if true, raises a serious issue of violation of human rights.

The Commission has also directed them to inform as to what action had been taken against the accused under the provisions of the Scheduled Castes and the Scheduled Tribes (POA) Act, 1989 including protection to the family of the victim and the monetary relief as admissible under the rules.

The media on the 1st September, 2012 reported that a 14 year old Dalit girl was gang raped a few days back. The culprits had also made an MMS of the incident and circulated it in the market, revealing her identity and making it difficult for her to go out. When the parents of the victim, in an apparent attempt to allow her overcome her trauma and start life afresh approached a school for her admission, the school management refused to admit her on the ground that the parents of the other students had threatened to withdraw their wards if the girl was given admission.
