NHRC recommends 3 lakhs monetary relief in a case of death of an under trial prisoner in UP

The National Human Rights Commission has recommended that the Uttar Pradesh Government pay monetary relief of 3 lakhs to the next kin of an under trial prisoner Mustan Sarulla khan @ Munna who died due to torture in jail.
The Commission received an intimation about the incident from the Superintendent of District Jail, Kanpur, Uttar Pradesh vide his letter dated 22nd June, 2005. Subsequent to the Commission’s notices to the concerned authorities in the matter, it was informed that Mustan Sarulla khan @ Munna was taken into custody on the 20th June, 2005, and, as he was not feeling well, he was admitted to the Jail Hospital. From there he was referred to the UHM Hospital on the 22nd June, 2005, where he was declared brought dead.
On consideration of the material on record, the Commission found that at the time of admission in the jail, it was noted that Sarulla khan had three injuries on his person, but inquest report showed that there was a series of injuries on his person. In the Post Mortem Report, it was stated that he died of cardiac failure due to high temperature. But it was noted that some of the injuries found on his body were on the palm and the sole of the foot, scrotum and genitals.
The Commission observed that various records show that the prisoner Mustan Sarulla khan @ Munna might have died of custodial torture. In this view of the matter, the Commission, on the 19th July, 2010 recommended monetary relief of 3 lakhs to the next of kin of the deceased Mustan Sarullakhan @ Munna.
A compliance report has also been sought from the Chief Secretary, Government of Uttar Pradesh within six weeks from the date of receipt of this communication.
