NHRC recommends 45 lakhs monetary in 8 cases of encounter in UP at its Camp Sitting in Lucknow

The National Human Rights Commission took up five cases in its Full Commission hearing today as part of its three day camp sitting at Lucknow in Uttar Pradesh. Out this a case was related to sexual abuse of three girls at Rajkiya Bal Griha, Allahabad in the year 2012. The State Government informed that six were convicted in the case by the Court and five others were acquitted by the court. In response to the Commission's query about the steps taken by the State Government to Prevent such incidents the State Government informed that it has constituted Committees in every districts headed by DM to monitor the situation. The Committees will also have one judicial officer, It has also prepared a guideline in this regard. The Commission asked the State Government to provide the details of the guidelines to the NHRC so that other states from where such incidents have had been reported, could be asked to follow them. The other cases related to refusal to admit a pregnant woman in a government hospital at Behraich. The Commission directed the State Government to pay Rs.15 Thousand as relief to the victim. In another case relating to manual scavenging in Bulandshahr, the Commission asked the State Government to hold an enquiry at a senior level and also asked to explain whether five thousand five hundred insanitary latrines which were demolished by the State Government were replaced by the sanitary latrines or not. The fourth case was related to demolition of hutments of Musahar community in Varanasi. The Commission asked the State Government to conduct fair enquiry on the demolition of the hutments by a builder. The fifth case was related to the issue of relief and rehabilitation of violence hit people in Muzaffarnagar and nearby areas which the Commission said would be taken up during the meeting with the senior officers on the 17th January, 2014.
In the Division Bench I, comprising Justice Shri K.G. Balakrishnan, Chairperson, NHRC and Shri S.C. Sinha, Member, NHRC 15 cases were taken up today. All the cases were related to police action including deaths in encounter and in police custody. Out of this, in two cases of encounter, the NHRC recommended monetary relief of Rs.5 lakh each to the next of kin of the deceased as it did not find police version convincing. In three cases, two of death in police custody and one of encounter, the Commission issued show cause notice to the State Government as to why monetary relief should not be paid. In one case, CBCID enquiry was ordered. Three cases were adjourned on account of non receipt of reports and further time was given. Total six cases were closed. Out of these in two cases, the poof of payment was provided by the State Government in compliance with the NHRC recommendations and the remaining four were closed on the merits after the Commission on consideration of reports found that there was no human rights violation.
In the Division Bench II sitting, comprising Justice Shri D. Murugesan and Shri Satyabrata Pal, Members, NHRC, 29 cases were taken up. All the cases were related to police action including deaths in encounter and in police custody.
In six cases of encounter, the Commission recommended Rs.35 lakh to the next of kin of the deceased. In two cases, show causes notices were issued as to why monetary relief should not be paid to the next of kin of the deceased and in one case CBCID enquiry was recommended. Two cases were closed on receipt of proof of payment of monetary relief on NHRC recommendations. Six cases were closed. In 29 cases, further time was given for submission of further reports.
In one case of encounter, the State Government, challenged the NHRC recommendation for monetary relief to the next of kin and the High Court granted stay. In another case of encounter, the State Government informed that is has decided to go to the High Court against the NHC recommendation. In both cases the Commission was not satisfied with the police version. Out of this, one case was related to encounter in Banda in 2008-2009 and the other related to encounter in GB Nagar in 2011.
Rest of the cases of police action will be heard tomorrow by the two Benches at Yojna Bhawan Bhawan, Lucknow.
