NHRC recommends Department of Posts to pay pension and other arrears due to a complainant with interest within four weeks.

New Delhi, 3rd June, 2013

The National Human Rights Commission has indicted the Department of Post, Government of India, in a case related with delay in payment of retiral benefits to an employee. It has directed the Director, Postal Accounts and Finance, Delhi and Assistant Director (PC), Office of the Chief Post Master General, Delhi to finalise the case of the complainant and make payments of arrears of pension and other dues to him with interest upto the date of payment.

The officers have been given four weeks time to respond positively, failing which, the Commission shall be constrained to issue a coercive process under Section 13 of the Protection of Human Rights Act, 1993.
The complainant in his complaint dated 25th August, 2012 had alleged non-payment of regular pension and gratuity since 2005 due to some disciplinary proceedings pending against him. However, despite the disciplinary proceedings having been finalized on 14th March, 2011, his regular pension and gratuity were not sanctioned.

The Commission, while considering the matter, observed inordinate delay on the part of the Department of Post in finalizing the pension. It said that there appeared to be no justification in not finalizing the pension and other dues of the retired employee despite lapse of more than two years.
