NHRC recommends Rs.6 Lakh monetary relief in a case of electrocution in Haryana

The National Human Rights Commission has asked the Government of Haryana to pay a sum of Rs.3 Lakh each as monetary relief to the next of kin of Prahlad and Rahul Mandal after it found that they were electrocuted due to the negligence of Dakshin Haryana Bijli Vitran Nigam (DHBVN) on the 28th August, 2011. It has also sought compliance report along with proof of payment within six weeks.

Earlier, in response to the Commission's notices, DHBVN and Police Commissioner, Faridabad, in their enquiry reports had confirmed the death of two persons due to electrocution by electricity pole stay wire. They also stated that the incident was accidental and not due to the negligence of electricity department personnel.

The Commission, during the course of enquiry, also called for a report from the Chief Electrical Inspector, Government of Haryana. In his report, he held, DHBVN responsible for infringement of Rule 90 of Indian Electricity Rules (IER) on the 11 KV line which led to this fatal accident.

The Commission issued a notice to the Haryana Government, through its Chief Secretary, to show cause why monetary relief should not be recommended to be paid to the next of kin of Prahlad and Rahul Mandal. Having received no response, the Commission concluded that there was a violation of human rights to life due to the negligence of the DHBVN officials and it being an undertaking of the Haryana Government, the State was liable to compensate the family suitably. Therefore, it recommended Rs.3 Lakh each as monetary relief to the families of both the deceased.

The Commission took cognizance of the incident on a complaint filed by a human rights activist.
