NHRC recommends two lakhs rupees to the next of kin
of a custodial torture victim

The National Human Rights Commission has recommended two lakhs to the next of kin of a deceased who died due to custodial torture in Maharashtra. The case relates to one Chandra Kant @ Kant Rao Bhagwan Rao Katmande who died in police custody on October 10, 2002. The Commission took cognizance of the matter on November 11, 2002 and directed the Investigation Division of the Commission to collect requisite reports from the concerned authorities. According to the reports received by the Investigation Division Chandra Kant was picked up by police on October 7, 2002 in a case under police station Kaij, in Beed district of the State. He remained in police custody for interrogation. During investigations, Sub-Inspector Sanjay Dattatray Sanap took the deceased from the lock-up. Chandra Kant suddenly fell ill and was taken to hospital where he was declared dead on October 10, 2002.
Inquest cum Panchnama and Post Mortem revealed the evidence of custodial torture. Magisterial enquiry report also confirmed custodial torture. As a result the case of murder was registered. The State CID carried out investigation and Sub-Inspector SD Sanap and Sub-Inspector G.S. Kanade besides Dr. S.K Goli Professor and Head of Department, Forensic Medicine were charge sheeted. The State CID informed that the State government had accorded prosecution sanction against Sanap and Kanade. The prosecution sanctioned against Dr. Goli was awaited from the Department of Medical Education and Research, Maharahastra Government.

Following these reports, the Commission issued a show-cause notice to the Maharashtra, Chief Secretary, as to why the provisions of Protection of Human Rights Act 1993, be not invoked and an interim relief to the next of the kin of the deceased be not recommended.
The Joint Secretary, Home Department, Government of Maharashtra through his communication dated September 2, 2006 stated that the matter of payment of interim relief to the next of kin of the deceased was under consideration of the State government. However, despite reminders, the Commission got no response from the State Government officials.
In these circumstances, the Commission considered it appropriate to recommend two lakhs rupees to the next of kin of the deceased and directed the State Chief Secretary to send a compliance report along with proof of payment.
