NHRC Reminder to Delhi Police in Batla House incident

On receiving a complaint from Shri Kamran Siddiqui about the incident which took place at L-18 Batla House, Jamia Nagar, Delhi on 19.09.08, the Commission, vide proceedings dated 23.09.08 directed the Commissioner of Police, Delhi to take appropriate action as per guidelines laid down by the Commission and to submit report within two weeks. Later on an intimation dated 21.09.08 was received from SHO P.S. Jamia Nagar on 13.10.08 regarding the same incident.
Commissioner of Police, Delhi has not submitted the required report so far.
In the meantime another communication dated 14.10.08 has been received from Shri Kamran Siddiqui. He has alleged that on 13.10.08 a team of Special Cell of Delhi Police made a visit to L-18 Batla House. It is alleged that the police team came with 2-3 bags and stayed at L-18 Batla House for two hours.
The Commission has decided to issue reminder to Commissioner of Police, Delhi directing him to transit the post-mortem report of Mohd.Atif, Mohd. Sajid and Inspector Mohan Chand Sharma and also the inquest reports. He will also inform the Commission:-
1. Whether a Magisterial enquiry has been ordered, if so, the status of Magisterial enquiry.
2. Whether a criminal case regarding the incident has been registered, if so, the status of the investigation.
3. Whether the team of Special Cell visited L-18 Batla House on 13.10.08, if so, the purpose of visit.
As per Commission's orders, a reminder has been sent to the Delhi police Commissioner requesting that the complete report as directed by the Commission in the matter be sent latest by 31.10.08, for consideration by the Commission.
