NHRC summons DM and SSP Allahabad on the incident related to the killing of Pinto Misra
New Delhi August 29, 2007 The National Human Rights Commission has expressed displeasure on the belligerent attitude of the UP authorities on the directions of the Commission in a case related to the killing of one Pinto Misra in Allahabad on Sep 18, 2006. The Commission has, further, summoned the DM, Allahabad with magisterial enquiry report and SSP Allahabad with post-mortem and inquest report to appear in person before the Commission on Oct 24, 2007. The Commission has also said that if the requisite reports are received by the Commission on or before Oct 17, 2007, the personnel attendance of the two shall stand dispensed with.
The Commission's latest move comes after its repeated directions to the State on the case fell on deaf ear.
The case related to the death of Pinto Mishra @ Arun Kumar, was brought to the notice of the Commission by SSP, Allahabad, Vijay Singh, Meena through a fax message on Sep 21, 2006. The message said that while a police party was checking the vehicles on Subhash Chowk on Sep 18, 2006, two persons on motorcycle without number plate came. When the police party intercepted this motor vehicle the pillion rider threw a bomb resulting in the death of Head Constable, Ashok Pandey. Soon the pillion rider tried to run away. He was chased and surrounded by the police. Finding himself in police trap, he threw bomb causing injuries to a Sub-Inspector and a Constable. The Police fired in self defence and the miscreant was killed.
The message also said that on search - a pistol, two magazines and five live cartridges were recovered from the dead and later on he was identified as Pinto Misra. A case was registered at the Police station, Civil Line, Allahabad regarding the incident the fax said.
The Commission on Oct 18, 2006 directed DGP, UP and SSP, Allahabad to take action and submit report within six weeks on the incident. The requisite reports were not received. Further, the case was taken up during the Camp Commission at Lucknow on Jan 19, 2007. The SP(Human rights) appeared before the Commission and undertook to submit the reports within four weeks. However, the undertaking was not honoured. Again on April 16, 2007, the Commission directed the State government to submit magisterial inquiry, postmortem and inquest reports within four weeks, this direction was also not complied with.
The Commission recently viewed the video clippings of the same incident provided by the media.
