On NHRC recommendations the Government of Bihar pays Rs. 3 lakh as relief in a case of death due to torture in police custody [08.06.2016]

The National Human Rights Commission's persistence with the Government of Bihar ensured that it eventually paid Rs. 3 lakh as relief to the family of Madan Yadav @ Sonu, who died due to torture in police custody at Police Station Barun in District Aurangabad on the 07th June, 2012, a day after his arrest. The Special Secretary, Home Department, Government of Bihar, in his personal appearance before the Commission, also informed that the next of kin of deceased Madan Yadav had also withdrawn the amount of relief from his bank account.

After its intervention, the Commission was informed that a case was registered against the delinquent police personnel under Crime No. 90/2012 under Section 302 IPC at Police Station Barun. The SHO and five constables were suspended. The victim, Madan Yadav s/o Bhura Yadav, resident of Kulahiya Hariharganj police station, district Palamu, Jharkhand was alleged to be a sub-zonal commander of a restricted organization C.P.I. (Maoist). He was arrested in Crime No. 35/10 u/s 147/148/149/331/435 IPC and 3/4/5 Exp. Act, PS Tandwa on the 06th June, 2012 and was brought to Police Station Barun for interrogation.

During the course of investigations, the Commission found several loopholes in police theory behind the death of the accused. Based on the material of record placed before it after a series of notices, it held that there was overwhelming evidence against the conduct of the police which could not satisfactorily explain the reason behind the injuries to the deceased which did not rule out the possibility of police torture under adverse environmental temperature amounting to violation of human rights of the victim.

The reports also revealed that there were contradictions and discrepancies in the police statements about the place of arrest of accused Madan Yadav, lack of medical examination after his arrest, the reason behind injuries on his body, his stomach being without food and water etc.
