Over rupees five lakh monetary relief in a case of assault by BSF personnel in West Bengal

Some personnel of Border Security Force were alleged to have caused grievous injuries to a family, including two women in Dakshin Dinajpur Belurghat, West Bengal. One of the assaulted persons succumbed to his injuries. In this connection, the General Security Force Court tried five accused personnel for committing offences under Section 45 of BSF Act and Rules, i.e., 'committing a civil offence read with Section 302 (culpable homicide amounting to murder) & 323 (voluntarily causing hurt) of IPC. The Court found all the five accused personnel not guilty of the above charges. However, the Magisterial inquiry report established that a group of BSF personnel caused grievous injuries to the members of a family. The Commission on consideration of the reports found the Magisterial inquiry report convincing and recommended that the Government of India pay rupees five lakh to the next of kin of deceased as monetary relief and rupees fifty thousand each to those injured in the assault by the BSF personnel. Proof of payment and compliance report was also sought.
