Persistence of NHRC results in UP government registering FIR in a case of kidnapping and rape in Banda and action against the erring police personnel: Also Rs 5 lakh paid as relief to the victim

The persistence of the NHRC, India over delayed police action in a case of kidnapping and rape in District Banda, resulted in criminal proceedings against the accused, action against the erring police personnel and payment of Rs five lakh as relief to the victim by the Government of Uttar Pradesh.

The Commission had received a complaint from the father of the victim on 14/09/2016. Allegedly, on 31/08/2016, the victim was kidnapped and was taken to Chitrakoot, Mehar and other places where she was raped multiple times. On 01/09/2016, the complainant reported the matter to the police. On 03.09.2016, the father of the accused produced the complainant's daughter before police who narrated the story of her kidnapping and rape. But the police did not arrest the accused and kept the victim in the police station for two days. She was not medically examined, nor her statement was got recorded in the court. After repeated request made by the complainant, an NCR was registered and the matter was closed. On further threats from the accused, the victim’s father requested intervention of the Commission.

Subsequent to the notices of the Commission, when the requisite reports of action in the matter were received from the state authorities, the Commission issued summons to the District Magistrate and Superintendent of Police, Banda, Uttar Pradesh for submission of requisite reports. Pursuant to the directions of the Commission, a report dated 08.01.2021 was submitted by the Superintendent of Police, Banda, Uttar Pradesh which reported that that the alleged incident relates to NCR No.127/2016, U/Sec. 498 IPC. On the written complaint, the FIR No. 294/2016, U/Sec. 366/376 IPC was registered against police personnel at P.S. Atra, District Banda. The accused was arrested on 01.10.2017.

Further, monetary compensation of Rs. 5 Lakhs was sanctioned by the Govt. pursuant to the direction of the Commission, which was credited to the account of the complainant through RTGS.
