UP Government directed to pay interim relief

The National Human Rights Commission has directed the Government of Uttar Pradesh to pay a sum of rupees one lakh as immediate interim relief to Rajesh Saini, who was injured after he was fired at by a co-prisoner in the police lock-up of Kotwali Shamli in Muzaffarnagar district.
Rajesh Saini had approached the Commission seeking that the offenders be punished and compensation be awarded to him. He alleged that he had been taken away by the police of Kotwali Shamli, distt. Muzaffarnagar from his house on 28 August 1996 to the police station where he was abused, beaten and tortured. He said the next day, two youths were brought by the police and kept in the same cell and after sometime, one of them fired at him, as a result of which he received injuries. He complained that the police did not take any action to save him.
The Commission issued a notice, in reply to which a report was received from the SSP, Muzaffarnagar. It stated that a co-prisoner had fired towards Rajesh Saini using a revolver of the Sub Inspector that had been handed over to a constable for keeping in malkhana. The report said a case had been registered against the prisoner, who had fired on Rajesh Saini. The SI and constable concerned who were found guilty of dereliction of duty have been placed under suspension.
Deeming it a prima-facie case for grant of immediate interim relief, the UP Government was directed to show cause why immediate interim relief be not granted to the victim. Since the State Government replied it had no objection, Shri P.C. Sharma, Member of the Commission directed that a sum of Rs.1.00 lakh be paid by the Government of UP to Rajesh Saini and the compliance report be submitted within eight weeks.
