Rupees fifty thousand monetary relief in a case of death due to drowning

Paramvir and two other labourers were digging for laying a Delhi Jal Board pipeline passing nearby metro pillar number 741 at Gulabi Bagh in the South-West district of the National Capital. While doing so, they struck a sewer pipeline which burst and flooded their trench drowning them. The fire brigade and police came in time to rescue the labourers. While two of them were saved, the third Paramvir s/o Komal Singh died in the mishap. The incident happened in the year 2009.
The Delhi Jal Board in response to the notice of the Commission had informed that the contractor of the private firm, which engaged the labourers for the job, had paid Rs. 1,35,000/- as compensation to the father of the deceased. It also said that action is being taken to debar the construction firm. However, the Commission observed that the Delhi Jal Board can not escape its liability to compensate the next of kin of the deceased under the garb of his employment by a contractor and payment of compensation by him. Holding Delhi Jal Board officials and the contractor responsible for causing death of Paramvir due to their negligence, the Commission recommended that the Delhi Government pay monetary relief of rupees fifty thousand to the next of his kin.
