Rupees five lakh monetary relief in a case of custodial death in Gujarat

Pratap alias Vikram Nathabhai Adivasi, aged 40 years, was arrested by police under various sections of IPC on the 16th June, 2005 in Gandhi Nagar, Gujarat. Two days later, he complained of breathing problem and was admitted to civil hospital, Gandhi Nagar where he died the same day. On intimation received from Superintendant of Police, Gandhi Nagar on the 18th June, 2005, the Commission called for requisite reports in the matter. On consideration of post mortem, magisterial inquiry and CID reports, the Commission found that there were 12 anti-mortem external injuries on the body of the deceased including fracture in the third rib. This made clear that Pratap was severely beaten in police custody which resulted in his death. The Commission in its notice to the State Government observed that prima facie Pratap was deprived of life against the constitutional guarantee for which monetary amends needed to be made for the next of his kin. When no response to this was received from the State Government despite reminders, the Commission observed that the state authorities have nothing to say in the matter and recommended that it pay rupees five lakh to the next of kin of the deceased as monetary relief.
