Rupees five lakh monetary relief in a case of death in encounter in U.P.

Sudhir was killed by police in an encounter on the night of the 22nd March, 2003 in District Meerut, Uttar Pradesh. The Commission received intimation about the incident the same day from Senior Superintendant of Police, Meerut. The police claimed that Sudhir along with his one accomplice fired at the police party when asked to stop their vehicle, and in self defense it had to open fire resulting in Sudhir's death while the other person escaped. The Commission called for the requisite reports in the matter from the state authorities. Subsequent to Commission's persistent follow up in the matter, the post mortem and magisterial inquiry reports were provided by the concerned authorities. On consideration of the material evidence, the Commission observed that the firing took place from a close range. The place of entry wounds and exit wounds reveal that police version is not only improper but incorrect. Therefore, it recommended that the Government of Uttar Pradesh pay rupees five lakh as monetary relief to the next of kin of deceased. The Commission has also called for a compliance report in the matter.
