Rupees five lakh monetary relief in a case of fake encounter

Dinesh Bhargava was shot dead by the Uttar Pradesh on the 7th October, 2003 in the area of police station Wazirganj, Lucknow. The matter was referred to the Commission by the SSP, Lucknow. The police claimed that Dinesh fired at a police party which was in search of a notorious criminal wanted in a murder case. In self defence, the police had to open fire resulting in his killing. On consideration of reports, the Commission found prima facie that the police version of the incident was doubtful and the possibility of Dinesh Bhargava being eliminated in an extra legal manner could not be ruled out. There was no response to the notice of the Commission from the U.P. government. Presuming that the State had nothing to say in defence of the police action, the Commission recommended that the Uttar Pradesh government pay Rupees five lakh as monetary to his next of kin.
