Rupees one lakh monetary relief in a case of death in judicial custody

Nagarajappa, aged about 35 years died on the 9th February, 2010 at the T.B. Sanatorium, Bellary in Karnataka. He was serving sentence in a criminal case and was lodged in the Central Prison, Bellary since the 10th October, 2004.
On consideration of the reports and the material on record, the Commission observed that at the time of his entry in the jail, Nagarajappa was neither a patient of HIV/AIDS nor Tuberculosis, T.B., which he might have contracted in judicial custody due to negligence of the jail officials. Had the authorities diagnosed the disease at the time of the admission of the convict in the jail and commenced his treatment, perhaps he would have not died so young.
Keeping in view the facts and circumstances in the case, the Commission recommended that the Government of Karnataka pay a sum of rupees one lakh as monetary relief to the next of kin of the deceased. The Commission also sought a compliance report.
