Kantilal Vallabh Bhai Talaviya was arrested on the 27th May, 2004 under section 41 of Criminal Procedure Code by the Gujarat police. He was lodged in police station, Vaidya, District Amreli. On the same day, he committed suicide by hanging himself to the ventilation window bar. On consideration of the post mortem and magisterial inquiry reports, the Commission found that the detaining authority had been negligent in ensuring proper supervision of the prisoner. A show cause notice was issued to the Government of Gujarat. There was no response from the state government.Therefore, the Commission presumed that the State government had nothing to say in its defence and recommended that the government of Gujarat pay monetary relief of Rupees one lakh to the next of kin of deceased.
