Rupees six lakh fifty thousand monetary relief in a case of assault by BSF personnel in Mizoram

The BSF personnel of the 105th Battalion were involved in an indiscriminate firing in district Lunglei, Mizoram on the 15th April, 2006. A villager named Gupalya Chakma died in the firing and seven others were injured. In this case, the General Security Force Court as per BSF Act and Rules awarded sentence to Umed Singh Mehta, Assistant Commandant (Retd.) for forfeiture of 10 years' past service for the purpose of pension. Inspector N.B. Bhatt was awarded sentence for forfeiture of three years' service for the purpose of promotion. As an immediate and long term relief to the family, Gyanabaran Chakma, son of deceased Gupalya Chakma was enrolled in BSF as a Safai Karamachari. However, it was contended in a communication from the Ministry of Home Affairs, Government of India that no compensation could be granted to any victim of the firing as there is no provision in the BSF Act 1968 and BSF Rules 1969. The Commission after considering the facts and circumstances of the case recommended that Ministry of Home Affairs, Government of India pay three lakh rupees to the kin of the deceased as monetary relief. It also recommended that the seven injured in the firing by the BSF personnel be paid rupees fifty thousand each.
