Rupees three lakh monetary relief in a case of death due to medical negligence in Kerala

Raju of Ayyadam Kunnu Paniya Colony, Peria 35, Mananthavady, district Wayanad Kerala was admitted to casualty department of the District Hospital on the 1st June, 2004. He was examined by a physician the next day. On the request of bystanders, he was allowed to be taken out of the hospital for Ayurveda treatment at Kalpetta. But, he was brought back to the hospital on the 6th June, 2004 in a critical condition, and was immediately put on resuscitation which failed and he expired. The District Medical Officer opined in his report that the incident occurred as the physician discharged the patient on the second day, as requested by him, for treatment of jaundice by traditional methods. The physician, who had discharged Raju, was suspended from the service and subsequently he retired. As the disciplinary proceedings were not finalized against him, his pensionery benefits were withheld.The Commission on consideration of the report, observed that it is a serious case of violation of Raju's human rights, who lost his life due to medical negligence and recommended that the Government of Kerala pay rupees three lakh as monetary relief to the next of kin of the deceased.
