Supreme Court stays proceeding against NHRC pending in Gujarat High Court
The Supreme Court has issued a notice to the High court of Gujarat and has stayed further proceeding pending before the High Court in the Public Interest Litigation against National Human Rights Commission, till further orders.
The NHRC had filed transfer petition in the Apex Court today with regard to this case.
A Public Interest Litigation, had been filed before the Gujarat High Court by a charitable organization questioning the jurisdiction of the Commission to inquire into disturbances in the State of Gujarat under Section 36 (1) of Protection of Human Rights Act, 1993.
The Apex Court has also issued notice and granted ex-party stay of further proceeding before the Tamil Nadu High Court in the case of Government of Tamil Nadu vs NHRC (Karunanidhi arrest case), where the Tamil Nadu Government had questioned the jurisdiction of this Commission under Section 36 (1) of Protection of Human Rights Acts, 1993.
