Three lakh rupees monetary relief in a case of death in police custody in Delhi

The National Human Rights Commission has recommended monetary relief of three lakh rupees to the next of kin of Inder alias Bengali who died in Delhi Police custody, in the night intervening 5th and 6th October, 2006. It was alleged in a complaint to the Commission that Inder was picked up from his house in the night and beaten severely at Police Station, Mayur Vihar resulting in his death.

The report from the Office of the Police Commissioner Delhi, dated 6th October, 2006 claimed that Inder alias Bengali was found loitering in suspicious condition near Police Booth 27 Block, Trilokpuri around 8.25 PM on 5th October, 2006. A button actuated knife was recovered from him and he was booked under Section 25 of Arms Act and lodged in the lockup of police station Mayur Vihar. On the next morning he was seen lying unconscious in the lockup and eventually died at Lal Bahadur Hospital, Khichripur.

The post mortem report revealed multiple injuries on his body. The Commission issued show cause notice to the Chief Secretary, Delhi Government as to why monetary relief should not be given to his next of kin. Delhi Government did not give specific response to the show cause notice. The Commission therefore, concluded that Delhi Government's failure to explain the injuries on the body of Inder lends credibility to the allegation that he was severely beaten by the police which led to his death and recommended monetary relief.
