TTE throws off a person on board a moving train (Case No.1524/24/4/2011)

The media carried a report on the 7th January, 2011 alleging that Mrs. Malti Devi and her husband, Mr. Rameshwar Mandal were travelling in a reserved coach of the Swatantra Senani Express Train on a general ticket on the 5th January, 2011. Allegedly, a T.T.E. threw them out of the coach of the moving train. This resulted in the death of Mr. Mandal and injuries to Mrs. Malti Devi. They were residents of village Nardhu Tola Basaitha, District Saharsa, Bihar and were on their way to Bhagalpur from Allahabad. It was reported that an FIR was lodged with the Government Railway Police, Muzaffarpur against an unidentified T.T.E.
The Commission in its proceedings on the 11th January, 2011, observed that the contents of the press report, if true, raise serious issue of human rights violation of Malti Devi and her husband and issued notices to the Chairman, Railway Board, New Delhi, Superintendent of Police (GRP), Allahabad, Uttar Pradesh and Superintendent of Police (GRP), Muzaffarpur, Bihar calling for their reports in the matter.
While issuing the notice to the Chairman, Railway Board, New Delhi, the Commission in particular asked him to provide information on the following points:-
i) Whether any ex-gratia amount is being paid to the next of kin of the deceased;
ii) Whether proper treatment is being given to the wife of the deceased for the injuries suffered by her along with the status of injuries suffered by her and;
iii) Whether any disciplinary action has been initiated against the delinquent public servant.
