UP Government asked to pay interim relief to Agra prison inmate

The Uttar Pradesh Government has been directed by the National Human Rights Commission to pay a sum of rupees five thousand to Shri Prem Chand who, while lodged in district jail, Agra, was attacked by co-prisoners and suffered injuries.
Shri Prem Chand's brother Shri Ujaal Singh approached the Commission stating that his brother was attacked with a broken bottle and blade by co-prisoners in connivance with jail officials. He said that no proper medical treatment was given to Prem Chand and no action taken against the miscreants.
Taking note of the complaint, notice was issued to IG (Prisons), UP. The report received admitted that the said incident took place in the jail precincts and there was negligence on the part of jail authorities. It stated that the jail staff who were found guilty of dereliction of duty were being dealt with.
The Commission, after considering the report, came to the conclusion that a prima-facie case for grant of immediate interim relief was made out. The State of UP through its Chief Secretary was, therefore, asked to show cause why immediate interim relief be not given to the injured. A status report of departmental inquiry was also called for.
A further report was received from DG, Prisons stating that the two wardens and head warden in charge of the said barracks, who were found guilty of negligence and dereliction of duty were placed under suspension and after completion of the departmental inquiry, their two increments were withheld. The Superintendent and Jailor concerned were punished with 'Censure'.
Since the victim Prem Chand was beaten by co-prisoners and suffered injuries, due to negligence and lack of proper control by the jail authorities, the Commission observed that liability of the State for payment of immediate interim relief cannot be doubted.
Shri P.C. Sharma, Member of the Commission directed the UP Government to pay a sum of Rs.5,000/- to Shri Prem Chand and send the compliance report within six weeks.
