Upon NHRC’s direction Rajasthan Government pays compensation of Rs. 1.00 lakh to victim of medical negligence
The Government of Rajasthan has paid Rs. 1.00 lakh as compensation to Smt. Bimla Devi upon the direction of the National Human Rights Commission. Smt. Bimla Devi’s uterus was removed in an act of medical negligence.
The Commission had taken cognizance of a complaint received from the Bihar State Students’ Union, R/O Muzaffarnagar, Bihar alleging that, on account of negligence of doctors of Sawai Mansingh Medical Hospital, Jaipur, Rajasthan, a 24-year-old woman, Smt. Bimla Devi who had been diagnosed and having stones in her stomach, was operated upon and her uterus was wrongly removed. The victim then had to undergo a further operation to remove the stones. The complainant sought the Commission’s intervention to protect the human rights of the victim and called for action against the guilty doctors.
Upon a notice being issued by the Commission, a report was received from the Government of Rajasthan, which admitted serious negligence on the part of the hospital, which was held responsible for the removal of the uterus of the victim. The concerned doctors had been suspended from service and charge-sheets had been filed for action against them.
On considering the report of the State Government, the Commission held that, though action had been initiated against the delinquent doctors, the victim deserved compensation for the grave loss she had suffered. A notice under Section 18 (3) of the Protection of Human Rights Act, 1993 was therefore issued to the Government of Rajasthan to show cause as to why a sum of Rs. 1.00 lakh be not paid to the victim.
The Commission has noted that, in response, the Government of Rajasthan has informed the Commission that, in accordance with the NHRC’s direction, Rs. I.00 lakh had been paid to the victim, Smt. Bimla Devi, from the Chief Minister’s relief fund.
