2. Sale of substandard drugs in Himachal Pradesh<br>



The Commission took suo-motu cognizance of a news report, which stated that according to a survey conducted by a voluntary organization, over 100 brands of substandard drugs are being sold in different markets of Kangra district of Himachal Pradesh. The report published in the Tribune on 8 June 2006 mentioned that most of the substandard drugs are being sold at Palampur, Dharamsala, Bhawarna, Nurpur, Nagrota Bagwan, Dehara Gopipur and Kangra on the prescription of medical officers posted in government hospitals. The report further stated that the medical officers had tie-ups with various drug companies and prescribing their drugs after getting huge commissions and financial benefits. According to the Tribune, many Chemists at Palampur had said that the profit to company on substandard medicines ranged from 200 to 300 per cent and part of it went to the doctors.
The report added, the companies manufacturing the substandard drugs are located at Mohali, Amritsar, Delhi and other places.
After observing the contents of the report, the Commission said if they are found to be true, they raise serious issues of violation of right to health - a basic human right.
The Commission has further directed that a copy of the news item be sent to the Secretary, Department of Health, Government of Himachal Pradesh and the Drug Controller, Himachal Pradesh for their comments and status of action, if any, taken by them within four weeks.
