Major Human Rights violation cases, which drew the Commission's attention



The Commission said that Right to Life is secured to citizens by Article 21 of the Constitution of India and if that right was endangered or taken away and the concerned authorities show an attitude of indifference or insensitivity to such incident, then the concerned authorities were prima facie guilty of omission in preventing the violation of human right. The Commissions' observation came in a case related to dowry death in New Delhi. The Commission also recommended action against the SDM, Seelampur, in the year 1998 and the Officer in-charge, Bajanpura, Police Station during the same period for their negligence in not registering an FIR in the case. The Commission also called for action against two other supervising police officers who did not take serious steps to collect the inquest report from the SDM, Seelampur. The Commission's recommendations came on a complaint filed in the year 1998. The case related to the death of a resident of Delhi who was harassed by her in-laws for dowry. The Commission further said that the Supervising police officers had been casual in their approach and there had been omission on their part. The Commission called for action against all the concerned officers not only on the departmental side but also to investigate about their complicity in hushing up the suspicious circumstances in the death of Sudha.
§ The Commission recommended to the Government of India that 63 Pakistani nationals who had sought asylum, should not be deported to their country till a proper decision on their request for asylum was taken by the Government. The Commission further recommended that these petitioners be treated in a humane manner and proper medical care and other basic amenities be provided to them as long as they were in India. The Commissions' recommendation came on a petition which prayed for NHRCs' intervention to save these Pakistani nationals from deportation. The petitioners had apprehended that they would be executed under the blasphemy law if they were sent back to their country.
§ The Commission expressed displeasure on the belligerent attitude of the UP authorities on the directions of the Commission, in a case related to the killing of one Pinto Mishra in Allahabad on Sep 18, 2006. The Commission further, summoned the DM, Allahabad with magisterial enquiry report and SSP Allahabad with post-mortem and inquest report to appear in person before the Commission. The Commission's move came after its repeated directions to the State on the case, fell on deaf ear. Since October 2006, the Commission had been requesting the State authorities to submit magisterial inquiry, post-mortem and inquest reports in the case where Pinto Mishra was killed when police fired in self-defence while checking the vehicles in Allahabad.
§ The Commission observed that the Bihar police seemed to be living in the old colonial days where the authorities showed scant regard for the dignity of the people. The Commission's observation came after it viewed a CD of a chain snatcher being thrashed by the public and the police joining them in humiliating him. The Commission said that it strongly disapproved such despicable behaviour as it was a serious issue of violation of human rights.
