Rupees five lakh compensation in a case of custodial death in Assam<br> (Case No. 158/3/2002-2003-CD)<br> <br>
Burman Moran was apprehended by the Army on the 5th February, 2003 on suspicion on having links with ULFA extremists. On the next day, he was produced at police station Doodooma by Hawaldar, Bunty Ram of the 6th Jat Regiment 99APO - Rupai, Dibrugarh, Assam. An FIR No. 18/2003 under various sections of the IPC was registered against Burman. But he died on the 8th February in the jail. The Deputy Commissioner, Dibrugarh, Assam sent intimation in this regard to the NHRC. It was stated that multiple injuries on his body caused by the army personnel led to his death. A show cause notice was issued to the Secretary, Ministry of Defence, Government of India. However, as there was no response to the show cause notice, the Commission presumed that the Ministry of Defence had nothing to say in the case and recommended through the Defence Secretary that the Government of India pay monetary relief of Rupees five lakh to the next of the kin of the deceased Burman Moran. The Commission also asked the Defence Secretary to provide information regarding the present posting of the 6th Jat Regiment to the Superintendent of Police, Tinsukhia at the earliest to expedite investigation on FIR.
